Common use of Changes in Common Stock Clause in Contracts

Changes in Common Stock. In the event that subsequent to the date of this Agreement any shares or other securities (other than any shares or securities of another corporation issued to the stockholders of the Company pursuant to a plan of merger) are issued on, or in exchange for, any of the shares of the Common Stock or Preferred Stock held by the Participating Parties by reason of any stock divided, stock split, consolidation of shares, reclassification, or consolidation involving the Company, such shares or securities shall be deemed to be Common Stock for purposes of this Agreement.

Changes in Common Stock. In the event that subsequent to the date of this Agreement any shares or other securities (other than any shares or securities of another corporation issued to the stockholders of the Company Corporation pursuant to a plan of merger) are issued on, or in exchange for, any of the shares of the Common Stock or Preferred Perini Voting Stock held by the Participating Parties Stockholders by reason of any stock divideddividend, stock split, consolidation of shares, reclassification, or consolidation involving the CompanyCorporation, such shares or securities shall be deemed to be Common Perini Stock for purposes of this Agreement.

Changes in Common Stock. In the event that subsequent to the date of this Agreement any shares of capital stock or other securities (other than any shares or securities of another corporation issued to the stockholders of the Company pursuant to a plan of merger) are issued on, on or in exchange for, for any of the shares of the Common Stock or Preferred Stock held by the Participating Parties Voting Shares by reason of any stock divideddividend, stock split, consolidation of shares, reclassification, reclassification or consolidation involving the Company, such shares or other securities shall be deemed to be Common Stock for purposes covered by and subject to the terms of this Agreement.

In the event that subsequent to after the date of this Agreement any shares of Common Stock or other securities (other than any shares or securities of another corporation issued to the stockholders of the Company pursuant to a plan of merger) or another corporation or other legal entity are issued onwith respect to, or in exchange for, any of the shares of the Common Stock or Preferred Stock held by the Participating Parties Shares by reason of any stock divideddividend, stock split, consolidation of shares, reclassification, exchange, merger or consolidation or otherwise involving the Company, such shares of Common Stock or other securities shall be deemed to be Common Stock Shares for purposes of this Agreement.

In the event that subsequent to the date of this Agreement any shares or other securities (other than any shares or securities of another corporation entity issued to the Company’s stockholders of the Company pursuant to a plan of merger) are issued onwith respect to, or in exchange for, any of the shares of the Common Stock or Preferred Stock held by the Participating Parties Stockholders by reason of any stock divideddividend, stock split, consolidation of shares, reclassification, reclassification or consolidation involving the Company, such shares or securities shall be deemed to be Common Stock for purposes of this Agreement.
