Change Order Records. DB Contractor shall maintain its records in such a manner as to provide a clear distinction between the direct costs of Maintenance Services for which it is entitled (or for which it believes it is entitled) to an increase in the Maintenance Price and the costs of other operations. DB Contractor shall contemporaneously collect, record in writing, segregate and preserve all data necessary to determine the costs of all Maintenance Services that are the subject of a Change Order or a requested Change Order, specifically including costs associated with design work. Such data shall be provided to any dispute resolvers, TxDOT and its Authorized Representatives as directed by TxDOT, on forms approved by TxDOT. The cost of furnishing such reports is included in DB Contractor’s predetermined overhead and profit markups.

Change Order Records. Contractor shall maintain its records in such a manner as to provide a clear distinction between the direct costs (as contrasted with indirect or impact costs) of Work for which it is entitled (or for which it believes it is entitled) to an adjustment in the Contract Price. Contractor shall contemporaneously collect, record in writing, segregate and preserve: (a) all information necessary to determine the costs of all Work which is the subject of a Change Order or a Request for Change Order; and (b) all information necessary to show the actual impact (if any) of the change on the Critical Path for the overall Project of all Work which is the subject of a Change Order or a proposed Change Order, if the impact on the applicable Project Schedule is in dispute. Contractor and Subcontractors shall establish and maintain an accounting system and records that properly accumulate and segregate incurred costs by line item for changes in the Work. Such information shall be provided to Owner and any authorized representative of Owner reviewing any Request for Change Order or Claim regarding compensation for such Work as provided in Article 12.

Fabricator shall contemporaneously collect, record in writing, segregate and preserve (a) separate daily occurrence logs, together with all other data necessary to determine the costs of all Work which is the subject of a Change Order or a requested Change Order, specifically including costs associated with design Work, and
Change Order Records. For cost data submitted in connection with Change Orders, unless such data is based on adequate price competition, established catalog or market prices of commercial items sold in substantial quantities to the public, or prices set by law or regulation, SANDAG and its representatives have the right to examine all books, records, documents and other data of Contractor related to the negotiation of or performance of Work under such Change Orders, for the purpose of evaluating the accuracy, completeness and currency of the cost or pricing data submitted. The right of examination shall extend to all documents deemed necessary by such Persons to permit adequate evaluation of the cost or pricing data submitted, along with the computations and projections used therein. Contractor shall make all such records available for inspection and copying immediately upon request.

  • Customer Records Customer grants to Cisco and its independent accountants the right to examine Xxxxxxxx's books, records and accounts during Customer's normal business hours to verify compliance with this Agreement.
