Common use of Certain Conditions Clause in Contracts

Certain Conditions. Any Financial Assets held by the Custodian for the benefit of the Fund pursuant hereto (including those Financial Assets held in a Depository) shall be considered by the parties hereto, and shall be at all times, the sole, absolute property of the Fund, and for purposes of this Agreement, shall be considered part of the Financial Assets held and maintained in the Custody Account.
