Cause of Action. A person who knowingly obtains, discloses or uses personal information, from a motor vehicle record, for a purpose not permitted under this chapter shall be liable to the individual to whom the information pertains, who may bring a civil action in a United States district court.
Cause of Action. As used in this Agreement, the phrase “cause of action” includes all claims, covenants, warranties, promises, agreements, undertakings, actions, suits, counterclaims, causes of action, complaints, charges, obligations, duties, demands, debts, accounts, judgments, costs, expenses, losses, damages and liabilities, of whatsoever kind or nature, in law, equity or otherwise.
Cause of Action. The parties hereby declare that the rights of the Company are of a unique nature, the loss of which may cause irreparable harm, and that it may be impossible to measure in money the damages which will accrue to the company by reason of the loss of such rights or a failure by the Executive to perform or adhere to any of the obligations under Sections 6.1 and 6.2 hereof. The Executive expressly acknowledges that remedies at law alone will be inadequate to compensate the Company for any breach or violation of any of the provisions of Sections 6.1 or 6.2 hereof, and that the Company, in addition to all other remedies hereunder or thereunder, shall be entitled, as a matter of right, to seek injunctive relief, including specific performance, with respect to any such breach of violation, in any court of competent jurisdiction.
Cause of Action. The Company agrees and acknowledges that in no event shall it have any cause of action, standing, claim, or any other rights against the Buyer or the Investment Manager with respect written instructions provided by the Buyer or disbursements made to the Investment Manager in accordance with Section 3.2. hereunder.
Cause of Action. ● No right or cause of action for any third party is created by the Agreement or any transaction under it. ● Neither party will bring a legal action arising out of or related to the Agreement more than two years after the cause of action arose. ● Neither party is responsible for failure to fulfill its non-monetary obligations due to causes beyond its control.
Cause of Action. No claim shall be payable under this Policy where the cause of action arises in India, unless otherwise specifically provided in the Policy Schedule/Policy Certificate.
Cause of Action. Any rights held by Seller to receive or recover property, debt, or damages on a pending cause of action, whether arising in contract, tort, or otherwise, including rights to indemnification, damages for breach of warranty or any other event or circumstance, judgments, settlements, and proceeds from judgments and settlements, but only to the extent relating to the Property and only to the extent of any damages accruing after the Closing Date (“Causes of Action”);
Cause of Action. Currency for payments Claims under this Policy shall be payable if the cause of action arises anywhere in the world accept for the below mentioned covers wherein the cause of action shall be restricted to India only:
Cause of Action. If Client makes a claim against BVNA, for any alleged error, omission, or other act arising out of the performance of its professional services and to the extent the Client fails to prove such claim, then the Client shall pay all costs including attorney’s fees incurred by BVNA in defending the claim. Any cause of action brought against BVNA shall be brought within one (1) year of the work or services performed under this Agreement.
Cause of Action. Claims under this Policy shall be payable if the cause of action arises anywhere in the world. For the below mentioned covers, the cause of action shall be restricted to India: ⚫ Modification Allowance ⚫ Out-patient Treatment Cover ⚫ Accidental Hospital Daily Cash Benefit ⚫ Convalescence Benefit ⚫ Accidental Hospitalization ⚫ Domestic travel for Medical treatment All Claims shall be payable in India and shall be in Indian Rupees only.
