CATS Parties’ Consequential Losses. ‌ The CATS Parties shall bear and shall defend, indemnify and hold the Shipper and the Shipper Group Operator harmless from and against any and all Consequential Loss of the CATS Parties or the CATS Operator arising out of or in connection with this Agreement, irrespective of the Wilful Misconduct, negligence or breach of duty (statutory or otherwise) of any one or more of the Shipper Field Capacity Parties.
