Care and Protection. Work(s) of art borrowed shall be given special care at all time to insure against loss, damage, or deterioration. The borrower agency agrees to meet any special requirements for installation and handling as noted on the face of this agreement form. Furthermore, AIPP may require an inspection and approval of the actual installation by a member of its staff as a condition of the loan. Upon receipt and prior to return of the works(s) of art, the borrower agency must make a written record of condition. The AIPP is to be notified immediately, followed by a full written report, including photographs, if damage or loss is discovered. No work of art may be altered, cleaned, or repaired without the written permission of the AIPP. Work(s) of art must be maintained in a building equipped to protect objects from fire, smoke, or flood damage; under 24-hour physical and/or electronic security; and protected from extreme temperatures and humidity, excessive light, and from insects, vermin, direct, or other environmental hazards. Art loaned by NMA has been examined and is considered to be in sound condition for loan. Only staff and contractors of NMA are authorized to handle, install, and relocate loaned work(s) of art.

Disclosure by Request or Order from Authority. Either Party may use or disclose the other Party's Confidential Information if required by any request or order of any government authority, or otherwise as required by law, or as necessary to establish and enforce that Party's rights under this Agreement. Before disclosing the other Party's Confidential Information for such purpose, the Party must notify the other Party of the circumstances, and the Parties shall cooperate with each other to obtain protection for the confidentiality thereof to the maximum extent available. Restrict Access. Nothing in this Agreement shall oblige the Client to disclose any information to Microland if it is of the view that to do so would be a breach of the Data Privacy requirements applicable to the Client. If any of the above should occur, Borrower shall send a full written and photographic condition report to the Vietnam Archive Archivist as soon as possible. • No object may be altered, cleaned, repaired or fumigated without the permission of the Vietnam Archive, except in an emergency situation when the safety of the work makes such action imperative.
