Common use of Capacity Interconnection Rights Clause in Contracts

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 36 MW. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 36 MW commencing June 1, 2020. During the time period from the effective date of this ISA until May 31, 2020 (the “interim time period”), the Interconnection Customer may be awarded interim Capacity Interconnection Rights in the amount not to exceed 36 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 2020.

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 36 MW. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 36 3.8 MW commencing June 1, 20202022. During the time period from the effective date of this ISA until May 31, 2020 2022 (the “interim time period”), the Interconnection Customer may be awarded interim Capacity Interconnection Rights in the amount not to exceed 36 0.8 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 3.0 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 0.8 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20202022.

Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 36 16 MW commencing June 1, 20202018. During the time period from the effective date of this ISA until May 31, 2020 2018 (the “interim time period”), the Interconnection Customer may be awarded interim Capacity Interconnection Rights in the an amount not to exceed 36 16 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20202018.

Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 36 84 MW commencing June 1, 20202019. During the time period from the effective date of this ISA until May 31, 2020 2019 (the “interim time period”), the Interconnection Customer may be awarded interim Capacity Interconnection Rights in the an amount not to exceed 36 84 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20202019.

Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 36 56 MW commencing June 1, 20202019. During the time period from the effective date of this ISA until May 31, 2020 2019 (the “interim time period”), the Interconnection Customer may be awarded interim Capacity Interconnection Rights in the an amount not to exceed 36 56 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20202019.

During the time period from the effective date of this ISA until May 31, 2020 (the “interim time period”), the Interconnection Customer may be awarded interim Capacity Interconnection Rights in the an amount not to exceed 36 44 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 2020.

Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 36 14 MW commencing June 1, 20206/1/2018. During the time period from the effective date of this ISA until May 31, 2020 6/1/2018 (the “interim time period”), the Interconnection Customer may be awarded interim Capacity Interconnection Rights in the an amount not to exceed 36 14 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20205/31/2018.

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 36 30 MW. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 36 MW 30MW commencing June 1, 20202021. During the time period from the effective date of this ISA until May 31, 2020 2021 (the “interim time period”), the Interconnection Customer may be awarded interim Capacity Interconnection Rights in the amount not to exceed 36 MW30MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20202021.
