Callout Provisions. (a) An employee who is called back to work outside his regular working hours shall be compensated for a minimum of three (3) hours at the applicable overtime rates. He shall be compensated from the time he leaves his home to report for duty until the time he arrives back upon proceeding directly to and from work. (b) Callout time which abuts the succeeding shift: (1) If the callout is for three (3) hours or less, the employee will be required to work the callout period and the whole of the abutting shift. ln this case, compensation shall be at overtime rates for the callout period and at straight-time rates for the regular shift. (2) If the callout is for longer than three (3) hours, the employee will be required to work the callout period and a portion of the abutting regular shift. (d2) In a callout situation where at least three (3) hours which do not abut the succeeding shift are worked in the ten (10) hours preceding the start of the regular shift, there shall be an elapsed time of eight (8) hours between the end of callout and the time the employee reports for duty on his/her next regular shift, with no shortfall out of the regular shift;
(3) If the elapsed eight (8) hour period following results in only two (2) hours or less of their regular shift available for work, employees shall not be required to report for work on that shift, with no shortfall.
(d) Time spent by an employee travelling to work or returning to his/her residence before and after callout shall not constitute time worked, but shall be compensated at the overtime rate.
(e) Should the employee be required to work that period which is considered free from work in the regular shift, as provided for in (b)(2), (c)(1), and (c)(2) above, then that portion of the shift shall be compensated at overtime rates.
