Common use of CAFA Notice Clause in Contracts

CAFA Notice. The Parties agree that the Defendant shall serve notice of the settlement that meets the requirements of CAFA, 28 U.S.C. § 1715, on the appropriate federal and state officials not later than ten (10) days after the filing of this Settlement Agreement with the Court.

CAFA Notice. A proposed form of CAFA Notice, without the accompanying attachments, is attached as Exhibit A. The Defendant shall file with the Court a certification of the date upon which the CAFA Notice was served.

At Defendants’ discretion, Defendants may use a third-party to serve the CAFA Notice, and the expense of sending such notice shall be paid from the Settlement Fund under this Settlement Agreement.
