None of the Company Technology fails to materially comply with any applicable warranty or other contractual commitment made by or on behalf of the Company or any Subsidiary relating to the use, functionality or performance of, or any product or system containing or used in conjunction with, such Company Technology. The Company has Made Available a true, correct and complete copy of its list as of the Agreement Date of all known bugs, defects and errors in each version and component of the Company Technology that is currently being supported and adversely and materially affects the performance of such Company Technology and has not been remedied as of the Agreement Date.
