Budgetary Limitations. Consultant agrees and acknowledges that budgetary limitations are not a justification for breach of sound principals of Consultant’s profession and industry. Consultant shall take no calculated risk in the performance of the Work. Specifically, Consultant agrees that, in the event it cannot perform the Work within the budgetary limitations established without disregarding sound principals of Consultant’s profession and industry, Consultant will give written notice immediately to the County.

Specifically, Contractor agrees that, in the event it cannot perform the Work within the budgetary limitations established without disregarding sound principals of Contractor’s profession and industry, Contractor will give written notice immediately to the County.

Budgetary Limitations. Nothing stated in this Agreement shall be construed as requiring either party to make any budgetary appropriations.
Budgetary Limitations. Firm acknowledges and agrees that Client is a governmental entity and, as such, is subject to an annual budgetary process and the limitation and restrictions of fiscal funding. Notwithstanding any other provision herein, if and to the extend the obligations of this Agreement, either in its initial term or in any automatically or otherwise renewed term, should continue over into Client’s subsequent fiscal years following that fiscal year when this Agreement was executed and funds are not appropriated or budgeted for this Agreement and completion of the term in question, Client may terminate this Agreement without penalty and shall have no further obligation or liabilities hereunder. However, if the Agreement is terminated pursuant to the terms above, Client agrees to pay for fees and charges incurred as of the termination date.
Budgetary Limitations. Applications for a tuition benefit shall be subject to limitations set forth in the Hospital’s Human Resources policy. Employees will be awarded the tuition benefit within budgetary limitations based on established criterion.
Budgetary Limitations. Notwithstanding the potential authorization that may be obtained pursuant to the terms of Paragraph 1 above, actual funding by the County during any budget year shall be limited to the amount appropriated, which is the actual amount of lodging tax revenues collected during the fiscal year from within the Telluride R1 School District, less the stated Colorado Department of Revenue administrative expense. Funding under this Contract shall not exceed actual net lodging tax revenues received for any fiscal year during the period of this Agreement. No funds from the County Lodging Tax Tourism Fund shall be expended for capital expenditures, except for tourism information centers; to the extent funding is appropriated for such purpose. Revenues appropriated pursuant to this agreement shall be derived solely from lodging tax receipts generated within the boundaries of the Telluride R1 School District.
Budgetary Limitations. The Client shall advise the Design Professional in writing either before execution, or within 15 days of execution, of this Agreement, of any budgetary limitations for the overall Project Cost or Construction Cost. The Design Professional will endeavor to work within those limitations. However, the Design Professional does not guarantee that any opinions it may render regarding the probable cost of construction or of any aspect of the Project will not differ materially from quoted fees, submitted bids, negotiated prices or actual costs ultimately incurred. If Client wishes greater assurance as to probable construction costs, or if formal estimates are otherwise desired, the Client must employ the services of an independent cost estimator.
Budgetary Limitations. Applications for tuition reimbursement benefit shall be limited to a maximum of six (6) credit hours per semester, up to a total of $3,000 per calendar year for full-time employees and a prorated amount for part-time employees (FTE of 0.5 through 0.8). There is a lifetime maximum of $12,000. Employees will be awarded the tuition reimbursement benefit within budgetary limitations based on established criterion.
Budgetary Limitations. The Parties acknowledge and agree that both Parties are governmental entities and, as such, are subject to an annual budgetary processes and the limitations and restrictions of fiscal funding. Notwithstanding any other provision herein, if and to the extent the obligations of this Agreement should continue over into Arlington’s or Fort Worth’s subsequent fiscal years following that fiscal year when this Agreement was executed and funds are not appropriated or budgeted for this Agreement and completion of the Term in question, Arlington or Fort Worth may terminate this Agreement. Each Party shall pay for its own performance in connection with this Agreement out of its own available current revenues.
