Bona Fide Request Quote Sample Clauses
The Bona Fide Request Quote clause establishes the process by which one party can formally request a price quote for specific goods or services from the other party. Typically, this clause outlines the requirements for submitting a legitimate request, such as providing sufficient detail about the desired products or services, and may specify timelines for the response. Its core function is to ensure that requests for quotes are genuine and detailed, thereby streamlining the quoting process and reducing misunderstandings or frivolous inquiries.
Bona Fide Request Quote. 3.4.1 If the Preliminary Analysis indicates that AT&T ILLINOIS will provide the BFR Item, MCIm may, at its discretion, provide written authorization for AT&T ILLINOIS to prepare a “BFR Quote”. The BFR Quote shall, as applicable, include: (i) the first date of availability, (ii) installation intervals, (iii) applicable rates (recurring, nonrecurring and other), (iv) BFR development and processing costs (v) terms and conditions by which the Request shall be made available, and (vi) any other information AT&T ILLINOIS deems relevant to MCIm’s request for the BFR Item.
3.4.1.1 MCIm’s written authorization to develop the BFR Quote must be received by AT&T ILLINOIS within thirty (30) calendar days of MCIm’s receipt of the Preliminary Analysis. If no authorization to proceed is received within such thirty (30) calendar day period, the BFR will be deemed canceled, subject to MCIm’s obligation to pay AT&T ILLINOIS’ reasonable costs incurred for the Preliminary Analysis as set forth herein. Any request by MCIm for AT&T ILLINOIS to proceed with the preparation of the BFR Quote received after the thirty (30) calendar day window will require MCIm to submit a new BFR.
3.4.1.2 As soon as feasible, but not more than ninety (90) (calendar) days after its receipt of authorization to prepare the BFR Quote, AT&T ILLINOIS shall provide to MCIm a BFR Quote.
3.4.2 Within thirty (30) days of its receipt of the Bona Fide Request Quote, MCIm must either confirm its order for the BFR Item pursuant to the Bona Fide Request Quote or cancel the Bona Fide Request and reimburse AT&T ILLINOIS for its reasonable costs incurred in the preparation of the BFR Quote. If MCIm believes AT&T ILLINOIS’ BFR Quote is inconsistent with the requirements of the Act, it may exercise its rights under the Dispute Escalation and Resolution sections of the Agreement. If, AT&T ILLINOIS does not receive notice of confirmation or cancellation of the BFR within such thirty (30) calendar day period, the BFR shall be deemed canceled and MCIm will reimburse AT&T ILLINOIS for its reasonable costs incurred in preparing the BFR Quote.
