Binding and Non-Binding Determinations. 1. Disputes subject to binding determination by the Independent Expert include: (i) fee disputes in accordance with Section 13.04(c); (ii) additional programs in accordance with Section 6.02; and (iii) other disputes agreed to by the Parties. 2. Disputes subject to non-binding determination by the Independent Expert include: (i) the occurrence and extent of Uncontrollable Circumstances; and (ii) other disputes agreed to by the Parties.
