Xxxxx acknowledges that Seller will not own title to the Properties at the time it delivers the list of Properties to Buyer, and that the Properties are owned by, and are being offered for sale at auction by, one or more third parties (each an “Ultimate Seller”) who are not owned or controlled by Seller.
