BENEFIT FUNDS. Section 10.1 Each Employer and the Employer’s controlled group agree to make contributions to the Painters District Council No. 30 Health and Welfare Fund, the Painters District Council No. 30 Pension Fund, the Painters District Council No. 30 Finishing Industries Retirement Savings Fund, Painters District Council No. 30 Health and Welfare Member Reimbursement Account Plan, the North Central Illinois Finishing Trades Institute, the International Union of Painters and Allied Trades Finishing Trades Institute, the Painters District Council No. 30 Labor Management Industry Development Fund, the Painters and Allied Trades Labor-Management Cooperation Initiative, and the International Union of Painters and Allied Trades Union and Industry Pension Fund, (collectively the “Combined Funds”), in accordance with the terms of this Agreement and with the Agreements and Declarations of Trust (“Trust Agreements”) under which each Fund is operated.

BENEFIT FUNDS the monies used to fund Client Benefit Payments deposited into a mutually agreed upon Custodial Account, the amount of the Benefit Fund allocated per Eligible Employee and then submitted per Enrolled Employee is determined by Client’s criteria, which will be provided to BenefitEd in writing in connection with execution of this Agreement.

BENEFIT FUNDS. 9.1 This Jobbers Agreement governs the benefit fund contributions paid by the Company on behalf of the employees of its Union contractors. In the event the Company contracts with a contractor that is party to a collective bargaining agreement with the Union or an affiliate thereof, the terms of which do not require the contractor to pay benefit fund contributions, the Company shall pay to the funds designated below the amount required under the terms set forth below. Any payment to the said funds shall neither bind nor commit the Company to the terms of, nor make the Company party to any collective bargaining agreement covering its contractors' employees.
