BCRC/DRUG TESTING. Section 1. The Union recognizes the right of the Employer to establish a drug testing policy for Employees. Section 2. In all situations where an Employer is required to agree to a testing program in order to qualify to be the successful contractor on a project, testing may be required, in accordance with the standards of this program, or, if the owner’s requirements for successful contractors are more stringent, in accordance with the owner’s requirements. No adverse employment action shall be taken against a worker solely because he/she refused a job assignment that has a substance testing requirement.
