Bank Client. Wal-Mart Stores, Inc., a Delaware corporation, Wal-Mart Stores Texas L.P., a Texas limited partnership, Wal-Mart Louisiana, LLC, a Delaware limited liability company, Wal-Mart Stores East, Inc., an Arkansas corporation, and Wal-Mart Stores East, L.P., a limited partnership formed under the laws of Delaware (each of the foregoing, individually and collectively, “Bank Client” or “Wal-Mart”)).

Bank Client. 2.1.10. The Bank shall be entitled to suspend the financial transaction if the Bank discovers the information that requires further analysis on the need for the Bank to take certain actions in order to fulfill its obligations under the legislation in the field of financial monitoring, including in case of coincidence of data of the financial transaction participant with the data of the person from the list of terrorists.
Bank Client. 2.4.12. Submit a confirmation of the balance of funds on the Account (-s) to the Bank as of January 1 of each current year. If such a confirmation is not be submitted to the Bank before January 31 of each current year, the balance of funds shall be deemed confirmed by the Client.
Bank Client. 9.1.2. If the Client is a non-resident of Ukraine, the disputes arising out of or in connection with performance of this Agreement by the Parties and not resolved through negotiations shall be referred to and resolved by the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry in accordance with its Rules. The law that applies to this Agreement is the substantive law of Ukraine. Notwithstanding the provisions set forth in this paragraph hereof, the Bank may bring an action in the court to settle any dispute according to the applicable laws of Ukraine that may arise out of or in connection with this Agreement.
