Bakersfield. The Parties agree to two (2) operation maintenance workers with 16 37% of their payroll expense shared by unregulated activities. This 37% is in 17 accordance with the recently adopted non-tariffed products and services (NTP&S) rules 18 whereby labor effort associated with these unregulated activities as estimated by 19 management is used to allocate payroll expense to such activities (e.g., City of 20 Bakersfield (CBK) operation, maintenance, and billing contract services). This means 21 37% of the overall affected payroll expense as it relates to unregulated activities does 22 not factor into determining Cal Water’s revenue requirement and thereby reduces 23 ratepayers’ rates. Bakersfield. EPA supports the decision by CHSRA and FRA to both (I) identify the Burlington Northern Santa Fe (BNSF) alignment as the prefe1Ted option for high speed train service connecting Fre no to Bakersfield, and (2) fully evaluate an additional alignment, such as the UPRR alignment, in project-level environmental review should the proposed additional plannin study identify a feasible and practicable alignment that is likely to be less damaging to water and biological resources. The BNSF and UPRR alignment have similar potential impacts to aquatic resources such as wetlands and streams, while the BNSF alignment has greater impacts to wildlife habitat. We are aware that local biologists are conrned about the potential impact that the BNSF alignment may have on movement con-idors for threatened and endangered species and the extent of conservation lands linking the last remaining stands of native habitat, including alkali grasslands and alkali sink crub. We are confident that the decision to analyze the BNSF alignrnent, as well as any alternative that is demonstrated to be less damaging to biological and water resources through the additional proposed study, will result in a high speed train alignment most likely to contain the LEDPA. Xxxxxxx Canyon an. 1\1iramar R ad As noted following in our comment le er on the Programmatic XXXX, both the Xxxxxxx Canyon and iramar Road alignments for connecting Mira Mesa to San Diego may affect downstream lagoons. The Xxxxxxx Canyon alignment will also affect the ability of this region to absorb seasonal and annual flood waters, will increase erosion and sedimentation, and may negatively impact the water quality of the downstream Los Penasquitos Lagoon. Because the Xxxxxxx Canyon alignment would a ect more vernal pools and more non-wetlands waters than the Miramar Road route, and because this area has been designated as a multiple habitat planning area (MHPA) through the San Diego Multiple Species Conservation Plan, EPA supports FRA and CHSRA's decision to analyze both the Miramar Road and the Xxxxxxx Canyon alignm nts at the project-level. Bakersfield. When an extra engineer misses a call and the engineer following the engineer who missed a call has been called for service, or it became necessary to call a demoted engineer for service as engineer on account of no available extra engineer, the engineer who missed the call will be required to remain off the board for twelve (12) hours from time of missing call. If call missed was for an outlying assignment he will be required, when reporting for work, and without expense to the Company, to relieve the engineer who was used in his place on the outlying assignment, if the vacancy still exists. When an extra engineer lays off for fifteen (15) days or less, his number or turn will not be taken off the board until after it has worked up to first-out, in order to determine the services he stood to be called for had he not laid off. If when again reporting for work following lay off period his turn has not been called he will be marked back in his original turn on the board. If the engineer following the engineer who laid off has been called for service, or it became necessary to call a demoted engineer for service as engineer on account of no available extra engineer, said engineer laying off will be marked at the foot of the extra board except in the event his turn when laying off stood to catch an outlying assignment and such vacancy still exists, he will be required, without Rule 23 expense to the Company, to relieve the Engineer who caught such outlying assignment.
