Average Length of Stay. The average length of stay of Medicare inpatients at each Facility shall have been greater than 25 days for the first five (5) consecutive months within the six (6) month period immediately prior to the Closing Date. Such calculation shall include Medicare Advantage inpatients if allowed by CMS.

Average Length of Stay. The length of stay at the Restpadd PHF is planned to meet the acute psychiatric needs of the patients referred to the program. CONTRACTOR will accept both voluntary and involuntary patients who meet the admission criteria for the program. It is expected that many of the patients referred to CONTRACTOR will be on an involuntary hold, which is limited to 72 hours. These patients may receive treatment beyond that time frame if they meet continued medical necessity. To continue treatment, a patient must either agree to be treated on a voluntary basis or must be mandated to continue on an involuntary basis by the proper legal authority. It is anticipated that the average length of stay at the PHF will be between 3 to 5 days. Stays of less than three days, or longer than five days, will be dependent on the individual needs of the patient. In all cases, individual care will be coordinated with the County Contract Administrator. Discharge planning and aftercare will be coordinated with the patient’s referring agency/caseworker to ensure post-discharge placement, medication support, and social, vocational, and educational services as appropriate. CONTRACTOR is responsible for coordinating the logistics for certification review, involuntary medication, and writ hearings. COUNTY is not responsible for providing staff for advocacy during these hearings or associated costs for these hearings.

All care provided, including discharge planning and aftercare is coordinated with the patient, the patient’s responsible party and the patient’s referring agency to ensure continuity of care, and appropriate discharge placement. Program Services: The program at North Valley Behavioral Health offers:

  • Waiver of Stay Each Pledgor covenants (to the extent it may lawfully do so) that in the event that such Pledgor or any property or assets of such Pledgor shall hereafter become the subject of a voluntary or involuntary proceeding under the Bankruptcy Code or such Pledgor shall otherwise be a party to any federal or state bankruptcy, insolvency, moratorium or similar proceeding to which the provisions relating to the automatic stay under Section 362 of the Bankruptcy Code or any similar provision in any such law is applicable, then, in any such case, whether or not the Administrative Agent has commenced foreclosure proceedings under this Agreement, such Pledgor shall not, and each Pledgor hereby expressly waives their right to (to the extent it may lawfully do so) at any time insist upon, plead or in any whatsoever, claim or take the benefit or advantage of any such automatic stay or such similar provision as it relates to the exercise of any of the rights and remedies (including any foreclosure proceedings) available to the Administrative Agent as provided in this Agreement, in any other Security Instrument or any other document evidencing the Indebtedness. Each Pledgor further covenants (to the extent it may lawfully do so) that it will not hinder, delay or impede the execution of any power granted herein to the Administrative Agent, but will suffer and permit the execution of every such power as though no law relating to any stay or similar provision had been enacted.
