Your account’s Available Balance is our most current record of the amount of money in your account that is available for use or withdrawal (subject to the additional limitations and restrictions set forth in this Agreement, including as further explained in the Disclosures and Schedules, including without limitation, “What You Need to Know About Overdraft Protection”; “Electronic Fund Transfers Agreement and Disclosures”; and “Funds Availability Policy”). The account’s Available Balance includes adjustments for factors such as restrictions or holds placed on deposited funds in your account, and restrictions or holds placed on funds in your account as a result of preauthorization holds in connection with the use of your Debit Card. Each of these restrictions and holds affects (reduces) the availability of funds in your account for use or withdrawal, including without limitation, to pay for checks drawn on your account, debits, Debit Card purchases, ACH transactions, ATM withdrawals, fees, and any other withdrawal or payment transactions on your account. We use the account’s Available Balance to authorize your transactions during the day, to pay your transactions in our nightly / daily processing, in determining whether the account has been overdrawn, and in assessing fees in connection with any overdrafts. IT IS VERY IMPORTANT TO UNDERSTAND THAT YOU MAY STILL OVERDRAW YOUR ACCOUNT EVEN THOUGH THE ACCOUNT’S AVAILABLE BALANCE APPEARS TO SHOW THERE ARE SUFFICIENT FUNDS TO COVER A TRANSACTION THAT YOU WANT TO MAKE. Your account’s Available Balance may not reflect every transaction you have initiated or previously authorized, including without limitation, your outstanding checks, automatic bill payments that you have authorized, authorized automatic withdrawals (such as recurring Debit Card transactions, transfers, and ACH transactions that we have not received for payment or received too close to our nightly/daily processing to include in your account’s Available Balance), the final amounts of Debit Card purchases (e.g., we may authorize a purchase amount prior to a tip you add or a gasoline purchase that exceeds the authorization amount). For example, an outstanding check will not be reflected in your Available Balance until it is presented to us and paid from your account. Your account’s Available Balance also may not reflect recent deposits to your account that are subject to our Funds Availability Policy. The available balance in your account is the current ledger balance minus holds placed on your account by us or by merchants for check card purchases, minus pending withdrawals and transfers from your deposit account. Holds on your account can be created by authorizations for payments on your check card, holds on checks deposited into your account that have not yet been paid by a payee bank, or management holds placed on your account by us. You agree that at our option, we may elect to honor a withdrawal request that overdraws the account, it is imperative that you take into account or we may dishonor the availability of funds in your account under request to avoid creating an overdraft. You agree to deposit sufficient funds to WITHDRAWALS: You agree we may refuse to allow a withdrawal request that exceeds any frequency limitation we may establish from time to time or that is attempted by a method not permitted by us. You agree that if we honor a nonconforming request, that does not obligate us to honor future nonconforming requests. You agree that Legacy will apply any frequency limitations based on the date a transaction causes is completed by us, as opposed to the Available Balance to fall below $0, a fee day you make the request. Fees for withdrawals from Money Market or Savings accounts will be assessedcharged in accordance with the service charge schedule. You agree withdrawals from time deposit accounts prior to maturity may be restricted and subject to penalty in accordance with the Notice of Penalties for Early Withdrawal. Although withdrawal requests normally will be paid upon demand, in complying with Regulation D of the Federal Reserve, you agree Legacy may require a seven day written notice of intention to withdraw funds from all interest-bearing accounts. FRAUD DETECTION/DETERRENCE: You understand that check fraud has increased dramatically in recent years due to a number of factors, including increased access by criminal elements to high-quality computer scanning and printing equipment. From time to time we may make certain products and services available to you that are designed to detect and/ or deter check fraud. While no product or service will be completely effective, we believe that the products and services we offer will reduce the likelihood that certain types of fraudulent items will be paid against your account. As a result, you agree that if you fail to implement any of these products or services, you will be precluded from asserting any claims against us for paying any unauthorized, altered, counterfeit or other fraudulent item that such product or service was designed to detect or deter, that we will not be required to recredit your account or otherwise have any liability for paying such items, and that you will indemnify us for any loss or expense (including, without limitation, reasonable attorneys’ fees to the extent permitted by law) relating in any way to such items as long as we have dealt with such items in good faith and in accordance with prevailing commercial banking standards (other than any such standards relating to the use of the products or services in question).

The Credit Union will permit a withdrawal only if you have sufficient available funds in your account to cover the full amount of the withdrawal or have an indication established overdraft protection plan. Checks, transfers or other payment orders that are drawn against insufficient available funds will be subject to a guarantee service charge set forth in the Rate Addendum and Schedule of Fees and Charges. You understand and agree that a purchase will not result in additional multiple attempts may be made to submit an item for payment and that multiple fees being may be charged to you as a result of these represented item(s). If there are sufficient available funds to cover some but not all of your withdrawal orders, the Credit Union may allow those withdrawals for which there are sufficient available funds in any order at the Credit Union's discretion. The Credit Union may also refuse to allow a withdrawal in other cases. For example, any dispute between the owners about the account (unless a court has ordered the Credit Union to allow the withdrawal); a legal garnishment or debited attachment is served; the account secures an obligation to the Credit Union; any required documentation has not been presented; or you fail to repay a Credit Union loan on time. You may be advised of the reasons for refusal if such action is taken. The Credit Union reserves the right to require members to give notice in writing of any intended withdrawals from any account (except checking accounts) of no less than seven (7) days and up to sixty (60) days, as required by law, before such withdrawal. OVERDRAFTS/COURTESY PAY Overdraft Liability. If on any day, the available funds in your checking account when the transaction is are not sufficient to cover checks and other items posted to your account, those checks and items will be handled in accordance with our overdraft procedures or an overdraft protection plan you may have with us. The Credit Union's determination of an insufficient account balance may be made at any time between presentation and the Credit Union's payment of item with only one review of the account required. The Credit Union has no duty to notify you of an insufficient funds item. The Credit Union may charge a fee for an insufficient funds item whether paid or returned as set forth in the Rate Addendum and Schedule of Fees and Charges. Except as otherwise agreed to in writing, the Credit Union, by covering one or any overdraft, does not agree to cover overdrafts in the future and may discontinue covering overdrafts at any time. If the Credit Union pays an item that would otherwise overdraw your account, you agree to pay the overdraft amount immediately. We reserve the right to pursue collection of previously dishonored items at any time. Courtesy Pay
1) Account is in "good standing", defined as an account that has not caused a loss to the Credit Union;
2) Checking accounts opened a minimum of 60 days;
3) No excessive NSF activity; and
4) No fraudulent transactions completed/attempted by you An overdraft occurs when you present a check, pre-authorized ACH, electronic transfer, or returned item for payment, and the payment of the item results in a negative available account balance. Automatic transfers from previously set up and approved overdraft protection account(s) (Savings account and/or overdraft line-of-credit) take precedence and will be processed prior to overdrawing a checking account with our Courtesy Pay service.
1) Courtesy Pay costs nothing unless it is used to pay checks, ACH debits, recurring debit card transactions, Online Bill Pay payments, or any other payment or withdrawal request for more than is on deposit in the account. It allows the Credit Union to pay an overdraft transaction from a Checking Account instead of declining the transaction or returning the check unpaid.
2) Courtesy Pay will only be activated when funds available through other overdraft arrangements have been exhausted.
3) No additional paperwork is required to participate in the Courtesy Pay for coverage on checks, automatic payments, or ACH transactions (including "recurring" debit card transactions) and no fees are applied to your account unless the service is used.
4) You are required to OPT-IN by signing a separate Courtesy Pay Plus Consent form ONLY IF you want the Credit Union to authorize and pay overdrafts for ATM and one-time or non-recurring debit card transaction.
5) You may also OPT-OUT of Courtesy Pay at any time by notifying the Credit Union. If you opt-out of Courtesy Pay entirely, overdrawn items will be returned unpaid and you will be charged a Non-Sufficient Funds fee (NSF) for each item returned.
6) With Courtesy Pay, you will be allowed to temporarily overdraft your checking account up to a maximum of $500, excluding any fees.
7) You must bring your account to a positive balance within 15 days from the date of the overdraft.
8) Payment of an overdraft may be refused at any time even though we may have previously paid the overdrafts. If we do not authorize and pay an overdraft, your transaction will be declined and you may be charged a fee if you do not have another overdraft protection account.
9) Payment of overdrafts is discretionary. For example, payment will not be made if a preauthorization occurs, and subsequent transactions are posted to your account before is not in "good standing", if you have too many overdrafts.
10) If we pay an overdraft on an account with more than one (1) owner on the pending transaction signature card, each owner drawing/presenting the item that creates the overdraft are jointly and severally liable for such overdrafts plus applicable fees.
11) Transactions post in random order as we receive them so we encourage you to keep careful records and practice good account management. This will help you avoid writing checks without sufficient funds and incurring the resulting fees.
12) You must show financial responsibility with your Credit Union checking account (that was or previous checking account at another financial institution as reported through credit and check reporting services).
13) The Credit Union may limit the subject number of accounts eligible for Courtesy Pay to one per household.
1) You will not be charged a Non-Sufficient Funds (NSF) fee if the preauthorizationitem presented is $5.00 or less. You are allowed three (3) is postedfree overdrafts per quarter. Therefore, in order to avoid fees and/or overdrawing your account, it is imperative that you take into account the availability of funds in your account under the terms of this Agreement and keep track of each deposit, use, transaction, and withdrawal (including without limitation, checks drawn on your account, debits, Freedom Debit Card purchases, ACH transactions, ATM withdrawals, fees, and any other withdrawal or payment transactions on your account), because you as the account Owner(s) is/are in the best position to know each of the activities occurring (or that have been scheduled and/or authorized to occur) on your account, and therefore, the funds available for use or withdrawal. Even though For information on transaction clearing process, please refer to Order of Transactions within your account’s Available Balance may not reflect each of these transactions, you must insure that, at all times, your Available Balance is sufficient to pay your authorized transactionsMembership and Account Agreement.
a. Preauthorization Holds. As more fully explained in the Preauthorization Holds paragraph of the “Electronic Fund Transfers Agreement and Disclosures” in the Disclosures and Schedules, when you use your Debit Card at certain merchants, the merchant may request a preauthorization hold from us in an amount that is the exact amount of the transaction, is less than the anticipated transaction amount or in an amount the merchant believes you might spend with them. The preauthorization hold may remain in place on your account for up to three (3) days, even after the transaction has been posted to your account. In some cases, the hold on Debit Card transaction is released prior to the merchant presenting the transaction for payment. When we receive transactions after the hold is released we must pay the merchant. These preauthorization holds affect (reduce) the availability of funds in your account, including without limitation, to pay for checks drawn on your account, debits and Debit Card purchases, ACH transactions, ATM withdrawals, fees, and any other withdrawal or payment transactions on your account. You cannot access funds that are subject to a preauthorization hold since they are not available funds. You must ensure that, at all times, sufficient funds are available (including to cover any preauthorization holds placed on the account) and remain in your account to pay for your Debit Card transactions. An authorization is not an indication or a guarantee that a purchase will not result in additional fees being charged to or debited from your account when the transaction is posted to your account. For example, if a preauthorization occurs, and subsequent transactions are posted to your account before the pending transaction (that was the subject of the preauthorization) is posted, causing the account’s Available Balance to fall below $0, a fee will be assessed when the pending transaction does post to the account (and fees may also be assessed for the additional intervening transaction(s) to the extent they resulted in a negative Available Balance at the time they posted to the account). For example, you purchase gasoline from a merchant and the merchant obtains an authorization for $1 and you purchase $50 in gasoline. When the item is received it is for an amount greater than the authorization. If the amount of the transaction causes the Available Balance to fall below $0, a fee will be assessed.

Available Balance. Your Member acknowledges and agrees that (i) the ledger balance for any Account maintained by Member at ▇▇▇▇▇▇▇▇▇ Financial will equal the actual balance in Member’s account at the beginning of a specific Business Day, excluding any holds or pending transactions that have not posted to the account’s , (ii) the Available Balance is our most current record of for any account maintained by Member at ▇▇▇▇▇▇▇▇▇ Financial will equal the amount of money in your account that is funds available for use immediate withdrawal or withdrawal (subject to the additional limitations and restrictions use, as set forth in this Agreementthe definition of “Available Balance” in Exhibit A, (iii) BASED ON THE PRACTICES OF MERCHANTS AND OTHER COUNTERPARTIES, DEBIT CARD TRANSACTIONS CAN APPEAR AND DISAPPEAR IN AN ACCOUNT OVER A PERIOD OF DAYS BEFORE FINALLY CLEARING WHICH CAN IMPACT THE REPORTED AVAILABLE BALANCE, (iv) MEMBER CAN INCUR OVERDRAFT CHARGES BY RELYING ON ANY AVAILABLE BALANCE INFORMATION, (v) account balance information provided online by ▇▇▇▇▇▇▇▇▇ Financial is not intended as a substitute for proper account maintenance, including as further explained the recording of Member’s debits in the Disclosures and Schedules, including without limitation, “What You Need to Know About Overdraft Protection”; “Electronic Fund Transfers Agreement and Disclosures”; and “Funds Availability Policy”). The account’s Available Balance includes adjustments for factors such as restrictions or holds placed on deposited funds in your accountan account register, and restrictions (vi) THE AVAILABLE BALANCE FOR ANY ACCOUNT MAINTAINED BY MEMBER AT CREDIT UNION DOES NOT REFLECT OUTSTANDING CHECKS OR DEBIT ITEMS THAT HAVE NOT BEEN PRESENTED FOR PAYMENT. Member will be solely responsible for any liabilities, damages, costs or holds placed on funds in your account as a result fees incurred by ▇▇▇▇▇▇▇▇▇ Financial with respect to any actions or omissions of preauthorization holds in connection Member related to Member’s available balance, along with the use of your Debit Card. Each of these restrictions and holds affects (reduces) the availability of funds in your account for use or withdrawal, including without limitation, to pay for checks drawn on your account, debits, Debit Card purchases, ACH transactions, ATM withdrawals, fees, and any other withdrawal or payment transactions on your account. We use the account’s Available Balance to authorize your transactions during the day, to pay your transactions in our nightly / daily processing, in determining whether the account has been overdrawn, and in assessing overdraft fees in connection with any overdraftseffect from time to time. IT IS VERY IMPORTANT TO UNDERSTAND THAT YOU MAY STILL OVERDRAW YOUR ACCOUNT EVEN THOUGH THE ACCOUNT’S AVAILABLE BALANCE APPEARS TO SHOW THERE ARE SUFFICIENT FUNDS TO COVER A TRANSACTION THAT YOU WANT TO MAKE. Your account’s Available Balance may not reflect every transaction you have initiated or previously authorized, including without limitation, your outstanding checks, automatic bill payments that you have authorized, authorized automatic withdrawals (such as recurring Debit Card transactions, transfers, and ACH transactions that we have not received for payment or received too close to our nightly/daily processing to include in your account’s Available Balance), the final amounts of Debit Card purchases (e.g., we may authorize a purchase amount prior to a tip you add or a gasoline purchase that exceeds the authorization amount). For example, an outstanding check will not be reflected in your Available Balance until it is presented to us and paid from your account. Your account’s Available Balance also may not reflect recent deposits to your account that are subject to our Funds Availability Policy.
