Auctioneers Clause Samples

Auctioneers. To hire one or more professional auctioneers to assist in the disposition of the Collateral, whether or not the Collateral is of a specialize nature;

Auctioneers. The auctioneers at the auction. In these general conditions the expression “the Auctioneer” includes his employees and agents and any person to whom conduct of the Auction is delegated. An offer to purchase any Lot whether by bidding at Auction or offering to purchase by private treaty or tender. Any person or commercial entity who offers to purchase any lot whether by bidding at live auction, online sale or offering to purchase by private treaty or tender. Every Bidder shall be deemed to act as principal unless the auctioneer acknowledge in writing that he acts as Agent on behalf of a named principal. A commission payable by the buyer on the completion of a Sale the amount of which is set out in the Special Conditions. The auctioneer, when acting as Agent for the Seller, may also receive commission from the seller.

Auctioneers. 5.1. The Auctioneers reserve the right to regulate the bidding and to refuse to accept any bid or bids (without giving any reason for such refusal) in their sole absolute discretion 5.2. In the event of any dispute on bidding the Auctioneers decision shall be final 5.3. The Auctioneers as agents and auctioneers for the Seller reserve the right to bid on the Seller’s behalf at the auction in such manner as they may think proper 5.4. The Auctioneers shall be under no financial liability to the Buyer or anyone deriving their interest through or under the Buyer in respect of any matters arising out of auction or the Particulars of Sale or these Special Conditions of Sale 5.5. Upon the date of auction (and within one hour after acceptance of his bid) the Buyer shall pay the Buyer's Premium to the Auctioneers.

Auctioneers. Section 4(bb) of the Disclosure Schedule sets forth the jurisdictions in which OGAC or any employee of OGAC is duly authorized to conduct business as an auctioneer. OGAC and such employees have obtained and complied with, and is in compliance in all material respects with, all permits, licenses and other authorizations that are required to conduct business as an auctioneer and a list of all such permits, licenses and authorizations is set forth in Section 4(bb) of the Disclosure Schedule, copies of which have been delivered to the Buyer by OGAC.
