Attorneys’ Fees and Interest. The prevailing Party in any action to enforce this Agreement or any action arising from its breach will recover its fees and expenses, including attorneys’ fees. Interest is due on any amounts not timely paid under this Agreement at a rate of ten percent (10%) per annum or the maximum nonusurious rate allowed by law.

If Employee fails to repay the Incentive Bonus as set forth in this Agreement and NCI refers the matter to an attorney for collection, Employee agrees to pay all costs and reasonable attorney’s fees incurred by NCI in connection with such collection efforts. In the event it becomes necessary for Lessor to employ an attorney to enforce collection of the rents agreed to be paid, or to enforce compliance with any of the covenants and agreements herein contained, Lessee shall be liable for reasonable attorney's fees, costs and expenses incurred by Lessor, and in addition, shall be liable for interest at ten percent (10%) per annum on the sum determined to be due by reason of breach of this lease, such interest to run from the date of breach of the lease.
