Executive understands and agrees that neither his job performance nor promotions, commendations, bonuses or the like from the Company give rise to or in any way serve as the basis for modification, amendment, or extension, by implication or otherwise, of his employment with the Company.

At-Will Employment. Notwithstanding any provision in this Agreement to the contrary, Executive hereby acknowledges and the Company agree agrees that Executive’s employment with the Company is for an unspecified duration and constitutes “at-will” employment. , and Executive further acknowledges and the Company acknowledge agrees that this employment relationship may be terminated at any time, upon written notice to the other party, with or without good cause Cause or for any or no causeCause, at the option either of the Company or Executive. However, as described in this Agreement, Executive may be entitled to severance benefits depending upon the circumstances of Executive’s termination of employment.

At-Will Employment. Executive employment and the Company acknowledge that this employment relationship may be terminated at any time, upon written notice to the other party, time with or without good cause or for any notice. Executive understands and agrees that neither Executive’s job performance nor promotions, commendations, bonuses or no cause, at the option either of like from the Company give rise to or in any way serve as the basis for modification, amendment, or extension, by implication or otherwise, of Executive’s employment with the Company. However, as described in this Agreement, Executive may be entitled to severance benefits and accelerated vesting of equity awards depending upon on the circumstances of Executive’s termination of employmentemployment with the Company.

At-Will Employment. Executive and the Company agree that Executive’s employment with is at-will and that, subject to Section 6(d) below, either Executive or the Company constitutes “at-will” may terminate Executive’s employment. Executive and the Company acknowledge that this employment relationship may be terminated , at any time, upon written notice to the other party, with or without good cause or for any or no cause, at with no prior notice; provided however that each party shall remain bound by the option either terms and provisions of this Agreement that survive the Company or Executive. At-Will Employment. Executive and the Company agree that Executive’s employment with the Company constitutes will continue to be “at-will” employment. Executive employment and the Company acknowledge that this employment relationship may be terminated at any time, upon written notice to the other party, time with or without good cause Cause or for any notice. Executive understands and agrees that neither his job performance nor promotions, commendations, bonuses or no cause, at the option either of like from the Company give rise to or Executivein any way serve as the basis for modification, amendment, or extension, by implication or otherwise, of his employment with the Company. However, as described in this Agreement, Executive may be entitled to severance benefits depending upon on the circumstances of Executive’s termination of employmentemployment with the Company.

In the event that either Executive and or the Company acknowledge that Employer terminates the employment relationship, this Agreement shall also terminate, effective the same date as the termination of the employment relationship. The at will nature of the employment relationship may only be terminated at any time, upon written notice to the other party, with or without good cause or for any or no cause, at the option either of the Company or Executive. At-Will Employment. Executive and the Company agree understand and acknowledge that Executive’s 's employment with the Company constitutes “at-will” will employment. Subject to the Company's obligation to provide severance benefits as specified herein, Executive and the Company acknowledge that this employment relationship may be terminated at any time, upon written notice to the other party, with or without good cause or for any or no cause, at the option either of the Company or Executive. However, as described in this Agreement, Executive may be entitled to severance benefits depending upon the circumstances of Executive’s termination of employment.

Executive and the Company acknowledge that this employment relationship between the Company and Executive may be terminated at any time, upon written notice to the other party, with or without good cause or for any or no cause, at reason. The preceding sentence does not apply to Executive’s position in the option either capacity as a member of the Company or Executive. HoweverBoard, as described in this Agreement, Executive may be entitled to severance benefits depending upon the circumstances of Executive’s termination of employmentthat is not an employment relationship standing alone.
