Association Rules. The Board may, from time to time and subject to the provisions of this Declaration, adopt, amend and repeal Association Rules, provided, however, that such Association Rules (or any amendments thereto) shall not be effective as to any Lot or Tract owned by Declarant unless either (i) such Association Rules have been approved by Declarant in writing, or (ii) such Association Rules were adopted (or amended) by a Board having a majority of its members appointed by the Declarant. The Association Rules may restrict and govern the use of any area by any Owner, by the family of such Owner, or by any invitee, licensee or lessee of such Owner except that the Association Rules may not discriminate among Owners and shall not be inconsistent with this Declaration, the Articles, the Bylaws or applicable law. Upon adoption, the Association Rules shall have the same force and effect as if they were set forth in and were a part of this Declaration.
Association Rules. The parties acknowledge that the Visa, MasterCard and Discover Network Association Rules give Visa, MasterCard and Discover Network certain rights to require termination or modification of this Agreement with respect to transactions involving Visa, MasterCard and Discover Network Cards and the Visa, MasterCard and Discover Network Card systems and to investigate You. The parties also acknowledge that issuers of other Cards, for which we perform services on your behalf, may have similar rights under their applicable Association Rules with respect to this Agreement’s applicability to transactions involving such other Cards.

Association Rules. (a) Retailer and Bank agree that, as of the Effective Date, the initial Association for all Co-Brand Credit Cards shall be MasterCard (the “Initial Association”). Retailer further acknowledges that Bank has entered into an arrangement with the Initial Association through which Bank is obligated to maintain the MasterCard brand on the Co-Brand Credit Cards issued under the Program through September 30, 2018 (which date, or such earlier date at which Bank is no longer obligated to maintain the MasterCard brand on the Co-Brand Credit Cards issued under the Program is called the “Branding Expiration Date”), and Retailer agrees that (i) prior to the Branding Expiration Date it shall not rebrand the Co-Brand Credit Cards with the brand of any payment network (e.g., [***]) other than MasterCard, and (ii) it shall include a requirement in any credit card program agreement or other arrangement with any Nominated Purchaser which acquires the Program Assets prior to the Branding Expiration Date (which Retailer shall use commercially reasonable efforts to enforce) that such Nominated Purchaser shall maintain the MasterCard brand on the Co-Brand Credit Cards through the Branding Expiration Date.

Association Rules. You agree to follow all requirements of this Agreement in connection with each Card transaction and to comply with the Visa USA Inc. Operating Regulations, the MasterCard Bylaws, and all other applicable Association Rules.

Association Rules. 15.1 The purchaser acknowledges that the Directors of the Association shall be entitled, at all times, to lay down rules in regard to the following matters on the estate:

The association rules shall govern the use of the common area including, but not limited to, any parking areas, any recreational facilities and private streets, by the owner or his family, guests, invitees or by any contract purchaser, or tenant or their respective family members, guests or invitees. The association rules shall not, however, be inconsistent with or materially alter any other provisions of this declaration, the articles or the bylaws. A copy of the association rules as adopted, amended or repealed shall be mailed or otherwise delivered to each owner and a copy shall be posted on an Internet site maintained by the association. In case of any conflict between any association rules and any other provisions of this declaration the articles or bylaws, the provisions of the association rules shall be deemed to be superseded by the provisions of this declaration, the articles or bylaws to the extent of any such inconsistency.
