Where a Relevant Supplier is bidding to provide New Goods and/or Services in circumstances where the Supplier or an Affiliate of the Supplier is already providing (or due to provide) Legacy Goods and/or Services to a Contracting Authority, the Supplier shall promptly provide the relevant Contracting Authority and/or the Relevant Supplier with all reasonable information and assistance as may be required from time to time to enable the relevant Contracting Authority and/or the Relevant Supplier, as appropriate, to: carry out appropriate due diligence with respect to the provision of the New Goods and/or Services; effect a smooth transfer and/or inter-operation (as the case may be) between the Legacy Goods and/or Services and the New Goods and/or Services; carry out a fair Further Competition Procedure for the New Goods and/or Services; and make a proper assessment as to the risk related to the New Goods and/or Services. When performing its obligations in Clause 6.1 the Supplier shall act consistently, applying principles of equal treatment and non-discrimination, with regard to requests for assistance from and dealings with each Relevant Supplier.

Sharing of information In any case where a Contracting Body wishes to procure Services ("New Services") in circumstances where the Supplier or an Affiliates of the Supplier is already providing (or due to provide) the Services or services similar to the Services ("Legacy Services") to that Contracting Body which is related to or which interfaces with or is intended to interface with or be replaced by the New Services, the Supplier shall promptly provide the relevant Contracting Body and any supplier bidding for those New Services ("Relevant Supplier") with all reasonable information and assistance as may be required from time to time to: carry out appropriate due diligence with respect to the provision of the New Services; effect a smooth transfer and/or inter-operation (as the case may be) between the Legacy Services and the New Services; enable the Contracting Body to carry out a fair Further Competition Procedure for the New Services; and enable the Contracting Body and Relevant Supplier to make a proper assessment as to the risk related to the New Services. When performing its obligations in Clause 6.1 the Supplier shall act consistently, applying principles of equal treatment and non-discrimination, with regard to requests for assistance from and dealings with each Relevant Supplier.

Sharing of information If a Contracting Body wishes to procure services which are the same as or similar to any of the Services ("New Services") from a third party bidding for such New Services (“Relevant Supplier”) in circumstances where the Supplier or an Affiliated Company of the Supplier is already providing (or due to provide): services similar to the New Services to that Contracting Body; and/or services which interface with or are intended to interface with or be replaced by the New Services, ("Legacy Services"), the Supplier shall promptly provide the relevant Contracting Body and/or the Relevant Supplier with all reasonable information and assistance as may be required from time to time to enable the relevant Contracting Body and/or the Relevant Supplier, as appropriate, to: carry out appropriate due diligence with respect to the provision of the New Services; effect a smooth transfer and/or inter-operation (as the case may be) between the Legacy Services and the New Services; carry out a fair Further Competition Procedure for the New Services; and make a proper assessment as to the risk related to the New Services.
