ASSESSMENT DISTRICTS. ASSESSMENT DISTRICTS. Borrower shall not voluntarily consent to or agree in writing to (i) any special assessment or (ii) the inclusion of any material portion of the Property into a special assessment district or other taxing jurisdiction unless Lender shall have consented thereto, which consent shall not be unreasonably withheld or delayed, or unless Borrower agrees to pay the cost thereof prior to the Maturity Date.
ASSESSMENT DISTRICTS. 25.1 Xxxxxxxxx agrees to consent in writing, on behalf of all real property in the Project, to inclusion of the Project in an assessment district to be formed by the District, or to annexation of such real property to an existing assessment district. Said consent shall be attached to this Agreement as Exhibit and incorporated herein by this reference. The real property in the Project may be included in, or annexed to, a fire suppression or parks assessment district formed. The authority for the park facilities assessment is the Landscaping and Lighting Act of 1972 located at Streets and Highways Code Section 22500 et seq. The code section authorizing the fire suppression assessments is Government Code Section 50078 et seq., any amendments thereto, or any other applicable provision of the law. The assessment district shall be used to provide funding for the maintenance and operation costs to provide parks and recreation or fire suppression services within the Project. Developer shall record a notice of this consent and any liens created as a result of the formation of said assessment district, or annexation to an existing assessment district, to ensure that prospective purchasers of individual lots within the Project are given the appropriate notice. Developer shall also provide to each purchaser, and the District, a copy of a preliminary title report giving notice of the assessment lien if a real estate public report is not yet available, or a copy of the real estate public report giving notice of the assessment lien upon its availability. Developer further agrees not to cause to be filed, or encourage the filing of, and waives its rights to file, any written protests to the inclusion of the Project in an assessment district, and/or the annexation of the real property encompassing the Project to an existing assessment district.
ASSESSMENT DISTRICTS. Unless otherwise required by applicable Law, Borrower shall not, without Lender’s prior written consent, cause or suffer to become effective, or otherwise consent to the formation of, any assessment district, or any other comparable or similar district, area or territory which includes the Project or any part of the Project which would require the Project to pay taxes higher than would otherwise be payable or require minimum tax payments or cause or otherwise consent to the levying of special taxes, assessments or payments in lieu against the Project or any part thereof, the levying of assessments by any assessment district against the Project or any part thereof, or the levying of assessments, taxes and/or other Impositions by any district, area or territory.
