ARTI. CLE XI: - BEREAVEMENT PAY When a death occurs in an employee's immediate family, the employee shall, upon request, receive the necessary time off up to three (3) days with pay, provided that he otherwise would have been scheduled to work at that time. An employee's immediate family shall be considered as spouse, children, father, mother, brother or sister, grandparents, father-in-law and mother-in-law, or any person who resided permariently with the employee's family in the employee's residence.
ARTI. CLE PAYMENT OF WAGES Wages shall be paid by cash not later than Friday of each week during working hours or by cheque no later than Thursday of each week during working hours. Accompanying each payment of wages shall be a retainable statement identifying both the Employer and the employee, showing the pay period, total hours marked and the hourly rate, the total earnings, the amount of vacation the amount and purpose of each deduction, and the net earnings.
ARTI. CLE 4'2.' SUCCESSOR 'CLAUSE. THIS AGREEMENT SHALL BE BINDING UPON THE EMPLOYER~S SUCCESSORS, ASS..IGNEES,PURCHASER, LEA SEE OR TRANSFEREES, WHETHER SUCH SUCCESSION, ASS.IGNMENT OR TRANSFER BE EFFECTED VOLUNTARILY' OR BY THE OPERATION OF LAW; AND IN THE EVENT OF THE EMPLOYER'S MERGER OR CONSOLIDATION WITH ANOTHER EMPLOYER, THIS AGREEMENT SHALL B.E BINDING UPON THE MERGED OR CONSOLIDATED EMPLOYER.

ARTI. ANALYTICS will provide Client access to the Licensed Software and Client accepts use of the Licensed Software under the terms of this Agreement. At the end of the Service Term or upon any breach of this Agreement by any member of the Client Group or Authorized Users, Client will stop all use of and access to the Licensed Software and Manuals. Upon the expiration of the Service Term or termination of this Agreement (see Clause 14), whichever occurs first, Client will return within five business days all copies or reasonable derivations, in whole or in part, of the Licensed Software, Manuals, and Confidential Information to ARTI-ANALYTICS, if these materials are in the Client’s possession.
ARTI. ANALYTICS or its affiliates, if applicable, will perform services and provide resources in accordance with this Agreement. The Professional Services will be detailed in Work Orders, which will be executed by the Parties from time to time under this Agreement.
ARTI. ANALYTICS will provide the Client with Professional Services and resources in accordance with the specifications, work scope and charges, agreed per separate contract and work order. Terms and conditions of this Agreement apply without deviation unless so specified and referenced in said workorder and/or contract.
ARTI. ANALYTICS shall follow its archiving procedures for Client Data. In the event of any loss or damage to Client Data, the Client's sole and exclusive remedy shall be for ARTI-ANALYTICS to use reasonable commercial endeavours to restore the lost or damaged Client Data from the latest back-up of such Client Data maintained by ARTI-ANALYTICS. ARTI-ANALYTICS shall not be responsible for any loss, destruction, alteration or disclosure of Client Data caused by any third party (except those third parties sub-contracted by ARTI-ANALYTICS to perform services related to Client Data maintenance and back-up).
