Common use of Architect’s On Clause in Contracts

Architect’s On. Site Visits: Architect shall visit the site at intervals appropriate to the stage of construction to observe the progress and quality of the executed work and determine, in general, if the work is proceeding in accordance with the contract documents. In carrying out this responsibility the Architect shall make on-site inspections not less than one (1) occasion per week and on the milestone dates for phases of the Project to check the quality and quantity of work on the Project. When observing the progress of the Project or when making inspections of the work on the Project, the Architect shall not be responsible for the construction means, methods, techniques, sequences, procedures or safety precautions incident thereto. Architect's efforts shall be directed toward Owner identifying non-compliance by the Contractor with the requirements of the contract documents. Architect shall not be responsible for Contractor's failure to perform the construction work in accordance with the contract documents. During such visits and on the basis of Architect's on-site observations as an experienced and qualified design professional, Architect is responsible to inform Owner of the progress of the work, shall alert the Owner to defects and deficiencies in the work of the Contractor and may disapprove or reject work that fails to conform to the contract documents.
