The Ministry of Education | Te Tāhuhu o te Mātauranga (the Ministry) and the NZEI | Te Riu Roa (NZEI) Collective Employment Agreement for Education Support Workers, Behaviours Support Workers and Communication Support Workers is due to expire on 8 December 2023. The Government and the CTU have been working through a Public Sector Pay Adjustment (PSPA) process. The parties have agreed that the PSPA should be applied to Support Workers, Behaviour Support Workers and Communication Support Workers employed by the Ministry of Education. To achieve this, the parties have agreed to vary the current collective agreement so that it expires early, and to replace it with a new collective agreement, the terms of which have also been agreed. This Terms of Settlement sets out the full terms of settlement of the variation to the 9 December 2021 – 8 December 2023 Collective Agreement, and the new Ministry of Education Support Workers’ Collective Agreement 3 April 2023 to 2 April 2025, an agreement between the Secretary for Education and NZEI. The variation and new collective agreement will now be put to the members to allow for a ratification vote pursuant to section 51 of the Employment Relations Act 2000. This offer remains open until 31 May 2023 or until Xx Xxxx Xxxxxxx or the Minister/Cabinet withdraw the Public Sector Pay Adjustment offer, whichever is sooner. After that time, backdating prior to ratification may not be possible. In settlement the parties agree to the following:

Letter of Understanding #1 – Public Sector Wage Increases Revised Collective Agreement Language Wage Re-Opener The collective agreement being negotiated is being negotiated in accordance with the PSEC Mandate established by government for the current collective bargaining. The HEABC agrees to provide a letter to the Community Bargaining Association stating that, in the event that government decides to modify the PSEC Mandate as it applies to the entire Public Service and Public Sector during the term of the Community Bargaining Association collective agreement arising from the current collective bargaining, the bargaining association will have the opportunity to renegotiate the total compensation for the balance of the term of the collective agreement. This opportunity to renegotiation will relate to total compensation only and such negotiations will be governed by the revised PSEC Mandate. This renegotiation will not result in the early termination of the collective agreement.
