Applicable Warranty. In deciding any Eligible Claims, apply the following warranties: If the issue is related to the transmission assembly (including torque converter and/or valve body) and/or the Automatic Transmission Control Unit, the Powertrain Warranty for 2014-2018 model year Nissan Rogue and 2015-2018 model year Nissan Pathfinder vehicles has been extended from 60 months or 60,000 miles, whichever occurs first, to 84 months or 84,000 miles, whichever occurs first. The Powertrain Warranty for 2015-2018 model year INFINITI QX60 vehicles has been extended from 72 months or 70,000 miles, whichever occurs first, to 96 months or 96,000 miles, whichever occurs first. For any other issue included with a transmission claim, apply the applicable coverage period in the New Vehicle Limited Warranty. Only Transmission Issues Occurring After December 22, 2021 To Be Considered In deciding the claim, BBB National Programs will only consider transmission performance issues, repairs or repair attempts, or any other conduct or events that occurred after December 22, 2021. Unless the claimant can establish that he/she opted out of the settlement, any claim based, in whole or in part, on any transmission performance issue, repair or repair attempt, or any other conduct or event on or before December 22, 2021 has been released as part of the settlement.

Applicable Warranty. The Products are subject to the Ovation warranty and limitation of warranty set forth in Exhibit 4.1 attached hereto.

RISK OF LOSS If you purchase any of the hardware Products directly from us, risk of loss or damage to hardware, will pass to you and acceptance will occur upon delivery to your “ship to” address or, if special shipping arrangements are agreed to, upon delivery to your carrier or designee. Title to hardware Products will pass from HPE to you upon full payment for or delivery of the Products, whichever is later. You agree to properly insure the Products for the benefit of HPE between the time risk of loss and damage pass and the time title passes.

  • Manufacturer’s Warranty The Goods include the manufacturer’s standard limited parts warranty to replace defective parts covered under such warranty exclusive of labor. Labor is warranted by the Elevator Contractor for 90 days following installation. The manufacturer’s parts warranty may require that the Goods be maintained throughout the warranty period by an authorized manufacturer’s representative under a separate maintenance contract. Any warranty is conditioned on written notice to the Elevator Contractor within warranty period and contingent upon receipt of final payment to Elevator Contractor.
