Common use of Applicable State Law Clause in Contracts

Applicable State Law. This agreement supersedes and prevails over all statutes of the State of Ohio, to the extent permitted by law, (except as specifically set forth in Section 4117.10[A], ORC), and all policies, rules and regulations of the Board which are in conflict with this agreement. However, if any provisions of this negotiated contract shall be found to be unlawful by any court of competent jurisdiction, such provision or application shall not be valid, but all other provisions or applications shall continue in full force and effect. Any provision found to be unlawful shall be changed to conform to law through negotiations between the Board and the Association. These negotiations shall take place at the most expedient and mutually agreeable time. If the parties fail to reach agreement over the affected provision, the dispute settlement procedure for this agreement shall be utilized to resolve the dispute.
