Common use of Applicable Permits Clause in Contracts

Applicable Permits. (a) The Concessionaire shall obtain and maintain at its cost all Applicable Permits, including all environmental permits, in conformity with the Applicable Laws and be in compliance therewith. Subject to the Concessionaire complying with the Applicable Laws and Good Industry Practice, the Authority shall facilitate the securing of such consents, clearances and Applicable Permits. (b) The Concessionaire shall expeditiously make necessary applications to the relevant Government Authorities for all Applicable Permits to meet the stipulated time frames in this Agreement, for completion of the Works, to achieve various performance milestones, if any, and to perform all of its other obligations under this Agreement. The Concessionaire shall supply the appropriate particulars and details to such Government Authorities as may be necessary to confirm that the Concessionaire fulfils the eligibility criteria to enable such Authority reasonably to consider the request for the grant of the relevant Applicable Permits and, following the grant of any such Applicable Permits, the Concessionaire shall maintain such Applicable Permits in full force and effect so long as it is necessary in order for the Concessionaire to perform its obligations hereunder.

Applicable Permits. i. The Authority shall, at the request of the Concessionaire, grant Applicable Permits with reasonable promptness that are in its authority and capacity to grant and, as the case may be, assist but without guarantees and/or without assuming any responsibility in that behalf and issue recommendatory letters and make best efforts to assist the Concessionaire in obtaining all the Applicable Permits from Government Authorities, Concessions to import equipment and materials required for the Project and immigration clearances, employment permits and residential premises for any foreign personnel engaged or employed by the Concessionaire in connection with the implementation of the Project, including renewals thereof; provided that nothing contained in this provision shall relieve the Concessionaire of its obligations under this Agreement to obtain the Applicable Permits and of being in compliance with the requirements of the same, provided further that the Concessionaire (a) The provides to the Authority all necessary relevant details and other information as may reasonably be required by the Authority and (b) keeps the Applicable Permits in force and effect throughout the Concession Period. ii. Upon written request from the Concessionaire, assist the Concessionaire shall obtain on best effort basis in obtaining access to all necessary infrastructure facilities and maintain at its cost all Applicable Permitsutilities, including all environmental permitswater, in conformity with the Applicable Laws sewerage, electricity and be in compliance therewith. Subject telecommunication facilities at rates and on terms no less favourable to the Concessionaire complying with the Applicable Laws and Good Industry Practice, the Authority shall facilitate the securing of such consents, clearances and Applicable Permitsthan those generally available to commercial customers receiving substantially equivalent facilities/utilities. (b) The Concessionaire shall expeditiously make necessary applications to the relevant Government Authorities for all Applicable Permits to meet the stipulated time frames in this Agreement, for completion of the Works, to achieve various performance milestones, if any, and to perform all of its other obligations under this Agreement. The Concessionaire shall supply the appropriate particulars and details to such Government Authorities as may be necessary to confirm that the Concessionaire fulfils the eligibility criteria to enable such Authority reasonably to consider the request for the grant of the relevant Applicable Permits and, following the grant of any such Applicable Permits, the Concessionaire shall maintain such Applicable Permits in full force and effect so long as it is necessary in order for the Concessionaire to perform its obligations hereunder.

Applicable Permits. (a) The Concessionaire Authorisee shall obtain and maintain at its cost all Applicable Permits, including all environmental permits, in conformity with the Applicable Laws and be in compliance therewith. Subject to the Concessionaire Authorisee complying with the Applicable Laws and Good Industry Practice, the Authority Grantor shall facilitate the provide necessary assistance in securing of such consents, clearances and Applicable Permits. (b) The Concessionaire Authorisee shall expeditiously make the necessary applications to the relevant Government Authorities for all Applicable Permits to meet the stipulated time frames in this Agreement, for completion of the Works, to achieve the various performance milestones, if any, and to perform all of its other obligations under this Agreement. The Concessionaire Authorisee shall supply the appropriate particulars and details to such Government Authorities as may be necessary to confirm that the Concessionaire fulfils Authorisee fulfills the eligibility criteria to enable such Authority authority reasonably to consider the request for the grant of the relevant Applicable Permits and, following the grant of any such Applicable Permits, the Concessionaire Authorisee shall maintain such Applicable Permits in full force and effect so long as it is necessary in order for the Concessionaire Authorisee to perform its obligations hereunder.

Applicable Permits. (ai) The Concessionaire shall obtain and maintain at its cost the Authority shall, upon written request, grant all Applicable PermitsPermits with reasonable promptness that are required for the implementation of the Project at the appropriate stages of the Project and which are in its authority to grant, including all environmental permits, in conformity with the Applicable Laws and be in compliance therewith. (b) The Concessionaire shall expeditiously make necessary applications to the relevant Government Authorities for all Applicable Permits to meet the stipulated time frames in this Agreement, for completion of the Works, to achieve various performance milestones, if any, and to perform all of its other obligations under this Agreement. The Concessionaire shall supply the appropriate particulars and details to such Government Authorities as may be necessary to confirm that the Concessionaire fulfils the eligibility criteria to enable such Authority reasonably to consider the request for the grant of the relevant such Applicable Permits andand making the requisite payments. (ii) the Authority shall assist Concessionaire to obtain requisite Applicable Permits from Government Authorities but is not obligated to do so. (iii) the Authority shall, following upon written request, assist the grant Concessionaire and the persons claiming through or under it, and as required issue recommendatory letters to the such persons, but without guarantees and/or without assuming any responsibility in this behalf, in obtaining all the Applicable Permits from Government Authorities, including licenses to import Medical Equipment, machineries and materials required for the Project and immigration clearances, employment and residential permits for any foreign personnel, and as applicable their dependants, engaged or employed by the Concessionaire/such persons in connection with the implementation of any such the Project, including renewals thereof. 2.1 shall relieve the Concessionaire of its obligation under this Agreement to obtain the Applicable PermitsPermits and of being in compliance with the requirements thereof, Provided further the Concessionaire shall maintain be required to provide the relevant details and such other information to the Authority as the Authority may reasonably require; and keep the Applicable Permits in full force and effect so long as it is necessary in order for throughout the Concessionaire to perform its obligations hereunderConcession Period.

(a) 6.13.1 The Concessionaire shall obtain and maintain at its cost all Applicable PermitsPermits for the purposes of the Project, including all environmental permitsmanaging, operating and maintaining the Project and Project Hospital in conformity accordance with the Applicable Laws and be in compliance therewithterms of this Agreement. Subject to the Concessionaire complying with the Applicable Laws and Good Industry Practice, the Authority shall use best efforts to facilitate the securing of such consents, clearances and Applicable PermitsPermits from the relevant Government Authority. (b) 6.13.2 The Concessionaire shall expeditiously make the necessary applications to the relevant Government Authorities for all Applicable Permits to meet the stipulated time frames in this Concession Agreement, for completion of the Works, to achieve the various performance milestones, if any, and to perform all of its other obligations under this Concession Agreement. The Concessionaire shall supply the appropriate particulars and details to such Government Authorities as may be necessary to confirm that the Concessionaire fulfils fulfills the eligibility criteria to enable such Authority authority reasonably to consider the request for the grant of the relevant Applicable Permits and, following the grant of any such Applicable Permits, the Concessionaire shall maintain such Applicable Permits in full force and effect so long as it is necessary in order for the Concessionaire to perform its obligations hereunder.
