APPLICABLE AUTHORITY. Funds provided under this grant agreement must be expended in accordance with all applicable federal statutes, regulations and policies, including those of the Workforce Investment Act (as presently in effect and as may become effective during the terms of this Agreement); the applicable approved State WIA plan including approved modifications and amendments to the plan, and any waiver plan approved under 20 CFR 661.420 or Workforce Flexibility (Workflex) plan approved under 20 CFR 661.430; the negotiated performance levels and policies established pursuant to the Secretary’s authority under WIA Section 136; and the applicable provisions in the appropriations act(s).
APPLICABLE AUTHORITY. Funds under this grant agreement must be expended in accordance with all applicable federal statutes, regulations and policies, including those of the Xxxxxx-Xxxxxx Act, as amended; the applicable and approved State plan(s) and any amendments; any negotiated performance levels; specifically approved statutory and regulatory waivers applicable to these funds; and the applicable provisions in the appropriation acts for these funds. The applicable State plans referenced above include the WIA/W-PA five-year Strategic State Plan and any modifications thereto (and for CO, MA, and MI only: including any demonstration of alternative service delivery methods approved as part of the applicable State Plan) and any other annual plans required for the receipt of funds under this agreement (e.g. cost reimbursable grants).
APPLICABLE AUTHORITY. The substantive laws of the State of Colorado (and not its conflicts of law principles) govern all matters arising out of, or relating to, this Agreement and all of the transactions it contemplates, including without limitation its validity, interpretation, construction, performance and enforcement. Venue for any action hereunder shall be in the District Court, County of Xxxxxxxxx, State of Colorado. Attorney expressly waives the right to bring any action in or to remove any action to any other jurisdiction, whether state or federal.
APPLICABLE AUTHORITY. Any competent court or any governmental or other regulatory body or official charged with the administration or the interpretation of any law, treaty, statute, rule or regulation. Applicable Base Rate Margin. The Applicable Base Rate Margin is set forth in Section 2.10(c).

(a) With respect to SOFR, the SOFR Administrator or any Governmental Authority having jurisdiction over the Agent or the SOFR Administrator with respect to its publication of SOFR, in each case acting in such capacity, (b) with respect to Term SOFR, CME or any successor administrator of the Term SOFR Screen Rate or any Governmental Authority having jurisdiction over the Agent or such administrator with respect to its publication of Term SOFR and/or the Term SOFR Screen Rate, in each case acting in such capacity, and (c) with respect to any Alternative Currency (other than Canadian Dollars), the applicable administrator for the Relevant Rate for such Alternative Currency or any Governmental Authority having jurisdiction over the Administrative Agent or such administrator with respect to its publication of the applicable Relevant Rate, in each case acting in such capacity.
APPLICABLE AUTHORITY. Funds provided under this Agreement must be expended in accordance with all applicable Federal statutes, regulations (including the Office of Management (OMB) and Budget Uniform Guidance), program directives, and the applicable provisions in the appropriations acts for these funds, and the terms and conditions of the award.
