Appear and Defend Sample Clauses
Appear and Defend. Assignor agrees to appear in and defend any action or proceeding purporting to affect the security hereof or the rights or powers of Assignee hereunder, and to pay all costs and expenses of Assignee including the cost of evidence of title and reasonable attorneys’ fees, in any such action or proceeding in which Assignee may appear or be named, and in any suit brought by Assignee to foreclose this Assignment.

Borrower shall appear in and defend any action or proceeding purporting to affect the security hereof or the rights or powers of the Lender or Trustee; and to pay all costs and expenses, including cost of evidence of title and attorney’s fees in a reasonable sum, in any such action or proceeding in which the Lender or Trustee may appear, and in any suit brought by the Lender to foreclose this deed.
