Antenuptial Agreement. Marital Property is all other property that is not non-marital property. This might include income earned during the marriage, pension or profit sharing plans, IRAs, deferred compensation and income (capital gain, ordinary income or otherwise) received from the appreciation of marital property. As in the case of rights upon death, each party may then grant to the other specific and detailed rights to property and income upon marital dissolution or legal separation. Examples of the agreed upon distribution in the event of marital dissolution or legal separation might include:  Jointly owned property to be divided equally.  Some agreement as to the obligation for debts incurred during the marriage but prior to commencement of separation.  Personal belongings of the parties will be divided equally, taking into consideration objects received by one party as a gift or from family inheritance. Specific provision may be made that the automobile each party is driving at the time of filing for legal separation or marital dissolution will remain that party’s property.  One spouse may agree to pay to the other a property settlement and/or spousal maintenance (previously referred to as alimony). The payment may be made based on years of marriage, whether children are born of the marriage or other criteria that apply to the situation. An antenuptial agreement cannot deal with parenting time or child support matters, as these will always remain in the discretion of the court using the best interests of the child standard.

  • Special Agreement Except for the termination of the Agreement due to the reason of Article 15, paragraph 1 of this Agreement, if the Agreement is terminated under any other circumstances, the payment made by Party B shall be regarded as Party B's liquidated damages, and Party A has the right not to return it.

  • Parties to Lock-Up Agreements The Company has furnished to the Underwriters a letter agreement in the form attached hereto as Exhibit A (the “Lock-up Agreement”) from each of the persons listed on Exhibit B.
