Annual Appropriations. The State’s performance and obligation to pay under this contract are contingent upon an annual appropriation by the Legislature.

Accordingly, the City’s performance and obligation to pay under this agreement is contingent upon annual appropriation.

Annual Appropriations. The School Boards' obligations under this Operating Agreement shall be contingent upon sufficient annual funding and appropriation by their respective governing bodies. Notwithstanding this contingency, each of the School Boards agrees that it shall include in its annual budget and seek appropriation of funds sufficient to meet its financial obligations under this Operating Agreement and the Lease Agreement attached hereto. To the extent permitted by law, the School Boards also agree that, in the event of non-appropriation of sufficient funds to meet their respective financial obligations to the Joint Board under this Operating Agreement and the Lease Agreement, they will not, in the same budget year, appropriate funds to provide services or placements to serve students that would otherwise be served by PREP at the Ivy Creek school as described in Section 1(d).

The Parties mutually agree and understand that NCHD’s funding under this Agreement is subject to annual appropriations by NCHD and that each fiscal year’s funding, if applicable, must be included in the budget for that year and is not effective until approved by NCHD’s Board of Managers and then approved by Nueces County Commissioners Court.
Annual Appropriations. The provisions of this MOU which require City to expend funds are expressly made subject to annual appropriation by the City. If, during any subsequent fiscal year the City shall fail to appropriate material funds to pay for the services to be provided hereunder, then and in that event RCEDP shall have the option to immediately terminate this MOU, and upon any such termination, neither party shall have any liability to the other arising from the otherwise unexpired term.
