Alternative Low Pressure Service Sample Clauses
Alternative Low Pressure Service. Should Supplier desire Low Pressure Service to be provided in a manner other than as set forth in Section 8.A above, Supplier may request in writing that Company prepare and present alternative plans for provision of Low Pressure Service to one or more Delivery Points then delivering into the High Pressure System. Within fifteen (15) Days after receipt of Supplier’s written request, Company shall present a plan to Supplier to provide such alternative Low Pressure Service for the subject Dedicated W▇▇▇▇ and/or Delivery Points. As a part of such plan, Company shall give written notice of whether it is willing to provide such alternative Low Pressure Service based on either or both of the following two options:
(i) Company converts the subject Delivery Points to Low Pressure Service at Company’s sole cost and expense and collects the Low Pressure Gathering Fee for Supplier’s Gas delivered therefrom after such conversion; or
(ii) Company converts the subject Delivery Points to Low Pressure Service, bearing only (**) percent (**)% of the Connect Costs incurred in connection with such conversion (both initially and on a continuing basis for any Connect Costs that will be incurred on an on going basis), with Supplier bearing the remaining (**) percent (**)% thereof, in which case Company shall forego the collection of, and waive Supplier’s obligation to pay, the Low Pressure Gathering Fee for Supplier’s Gas delivered therefrom after such conversion. Company may not be required to submit a proposal for such alternative Low Pressure Service for conversion of a Dedicated Well or Delivery Point to Low Pressure Service if same has been connected to the High Pressure System for less than sixty (60) Days. To the extent Company is entitled to reimbursement by Supplier for any Connection Costs, Company shall invoice therefor, and same shall be payable by Supplier, in accordance with Section A.7 of the General Terms and Conditions.
