Alternative Cash Payment. As an alternative to filing a claim for reimbursement of Ordinary Losses, Attested Time Spent, or Extraordinary Losses, Settlement Class Members may submit a claim to receive a pro rata payment from the net Settlement Fund after payment of costs of the settlement including the costs of carrying out the Notice Program and Claims Administration, any approved Attorneys’ Fees and Expenses Award, any approved Service Award to Representative Plaintiffs, and payments for claims for Ordinary Losses, Attested Time Spent, and Extraordinary Losses. Should Settlement Class Members chose to select an Alternative Cash Payment, there is a possibility that they may receive no payment if the total approved claims for Ordinary Losses, Attested Time Spent and Extraordinary Losses plus the costs of the Notice Program and Claims Administration, any Attorneys’ Fees and Expenses Award and Service Award exceed the total amount of the Settlement Fund.
Alternative Cash Payment. As an alternative to filing a Claim Form for reimbursement of Ordinary Losses, Attested Time Spent, or Extraordinary Losses, you may submit a Claim Form to receive a pro rata (a legal term meaning an equal share) payment from the net Settlement Fund, which is $2,450,000 minus payment of costs of the Settlement including the costs of the Notice Program and Claims Administration, Attorneys’ Fees and Expenses of up to $661,500, Service Awards of up to $1,500 each to the Representative Plaintiffs, and payments for claims for Ordinary Losses, Attested Time Spent, and Extraordinary Losses. Please note that if costs of the Settlement, fees and expenses, service award and payments for claims exceed the Settlement Fund, you may receive no payment if you select this category.
Alternative Cash Payment. In lieu of all other settlement benefits listed in Paragraphs 2.3.1(a), 2.3.1(b), and 2.3.1(c) above, each Settlement Class Member may choose to receive a cash payment in the amount of $75, subject to a pro rata adjustment (upwards or downwards) as set forth in Paragraph 2.10 after all other expenses are paid from the Settlement Fund.
Alternative Cash Payment. In the alternative to all of the Settlement Benefits provided for under Paragraphs 4-6 above, any Settlement Class Member (excluding Social Security Number Class Members) may submit a Claim to receive a cash Settlement Payment in the amount of twenty-five dollars ($25). Any Settlement Class Member who submits a claim for an Alternative Cash Payment will not be permitted to select any of the other Settlement Benefits provided for under Paragraphs 2-4 above.
Alternative Cash Payment. □ Check this box if you wish to receive an Alternative Cash Payment instead of payment for Unreimbursed Losses, Lost Time, and/or Credit Monitoring. The amount of the Alternative Cash Payment will depend on the amount of claims for Alternative Cash Payments and the amount of funds remaining in the Settlement Fund after all other distributions have been made, as explained in the Settlement Agreement. Alternative Cash Payments are separated between Tier 1 and Tier 2. Guardian will cause to be provided to the Settlement Administrator information regarding whether a Settlement Class Member’s Social Security number was affected in the Data Incident or not. If your Social Security number was affected in the Data Incident, your claim will be considered a Tier 1 Alternative Cash Payment. If not, your claim will be considered a Tier 2 Alternative Cash Payment. The Postcard Notice you received in the mail stated which Alternative Cash Payment you will be eligible to receive. You may NOT claim the Alternative Cash Payment AND claim Unreimbursed Losses, Lost Time, and/or Credit Monitoring. If you claim the Alternative Cash Payment, you give up the right to receive reimbursement for Unreimbursed Losses, Lost Time, and Credit Monitoring.
Alternative Cash Payment. In lieu of filing a claim for reimbursement of out-of-pocket losses, attested time, or for credit monitoring, all Settlement Class Members may file a claim for an alternative cash payment of $50.00. By filing a claim for an alternative cash payment, Settlement Class Members are giving up their right to file a claim for any other benefits made available under this settlement. Confirmatory Discovery: Defendants have also agreed to provide documents and information to Class Counsel showing that Defendants have taken data security measures to remedy the issues that led to the Data Incidents and has implemented other business practices to help ensure information security.
Alternative Cash Payment. (a) At SFV’s absolute discretion, SFV may agree to accept a cash payment from LTES Operator proposed under clause 14.5(b)(iii) that is:
Alternative Cash Payment. All Settlement Class Members who do not submit a claim for Out-of-Pocket Losses may submit a claim for the Alternative Cash Payment of $50.00. To receive reimbursement for the Alternative Cash Payment, Settlement Class Members must submit a valid Claim Form.
Alternative Cash Payment. In the alternative to compensation for Ordinary Losses and Attested Lost Time, Class Members may simply make a claim for a cash payment of one hundred dollars ($100.00). Alternative Cash Payment. While the amount of the pro rata payment will depend upon the number of approved claims for the other settlement benefits and the number of claims for this cash payment, it is estimated that the Alternative Cash Payment will be between $25 and $50 per claimant, based upon the size of this Settlement Class, historic claims rates for Alternative Cash Payments, and the size of the Settlement Fund here.
