All Settlement. Class Members who fail to timely submit a valid settlement claim hereunder within the time frames set forth herein, or such other period as may be ordered by the Court or otherwise allowed, shall be forever barred from receiving an Award pursuant to this Agreement, but will in all other respects be subject to, and bound by, the provisions of this Agreement, the Releases contained herein and the Final Approval Order.
All Settlement. Class Members who do not submit a timely, written request for exclusion in the manner set forth in the Notice and Agreement shall be bound by any Final Order and Judgment entered, even if such Settlement Class Members never received actual notice of this Action or this Proposed Settlement, or never submitted a claim pursuant to the Proposed Settlement. If final approval of the Proposed Settlement is granted, they shall be barred, now and in the future, from asserting any of the Released Claims, as defined in the Agreement, against any Released Persons, as defined in the Agreement.
All Settlement. Class Members who have previously executed CRAs from DuPont as part of the Imprelis® Claim Resolution Process, including those who already have received consideration, will be bound by these CRAs except as otherwise expressly provided in this Agreement should this Settlement become Final or in writing by DuPont. Should this Settlement become Final, these Settlement Class Members who have previously executed CRAs will receive the full benefits of this Settlement other than those relating to the Appeal Process.
All Settlement. Class Members who fail to timely submit a claim for any benefits hereunder within the time frames set forth herein, or such other period as may be ordered by the Court, or otherwise allowed, shall be forever barred from receiving any payments or benefits pursuant to the settlement set forth herein, but will in all other respects be subject to, and bound by, the provisions of the Settlement Agreement, the releases contained herein and the Judgment.
All Settlement. Class Members who do not submit a timely Settlement Claim Form, or submit a Settlement Claim Form that is disallowed and not cured, shall be barred from participating in the Class Settlement (except to the extent that a Settlement Claim Form may be partially allowed) but otherwise shall be bound by all of the terms and provisions of the Agreement; and
All Settlement. Class Members who do not submit a valid and timely Opt-Out Letter to opt- out of this Settlement shall release any and all Released Claims, as described in more detail in Section 8 of this Settlement Agreement.
All Settlement. Class Members who do not validly opt out and exclude themselves are hereby enjoined from pursuing or prosecuting any of the Released Claims as set forth in the Settlement Agreement until further order of the Court.
All Settlement.
