Common use of All Remedies Clause in Contracts

All Remedies. If, upon a Non-Relocation Default, the equitable remedies and liquidated damages provided for in Section 5 are unavailable for any reason, each of the County and ECSC shall be entitled to pursue all other legal and equitable remedies against the Bills, whether or not such other remedies are specifically set forth in this Agreement. Except as expressly set forth in this Agreement, all such other legal and equitable remedies of the Parties are cumulative and may be exercised concurrently, successively, or in any order. Nothing in this Section 6 shall be read or interpreted to negate, forgo, or waive the County or ECSC’s rights to obtain equitable relief or liquidated damages as set forth in Section 5 of this Agreement.
