Agreement Not Exclusive. The rights and benefits of Indemnitee, and the obligations of Indemnitor, under this Agreement shall be in addition to, and shall not supersede or be in lieu of, the provisions (if any) in the certificate of incorporation or bylaws of Indemnitor relating to the indemnification of Indemnitee by Indemnitor; the provisions of policies of insurance of Indemnitor; the provisions of policies of insurance or indemnification arrangements provided by persons or entities other than Indemnitor; or applicable law. Notwithstanding anything to the contrary in this Agreement, Indemnitor shall defend, indemnify and hold harmless Indemnitee to the full extent permitted from time to time by applicable law. Indemnitor, however, shall not be liable to Indemnitee to make any payment with respect to any claim made against Indemnitee for which payment is actually made to Indemnitee under a valid and collectible insurance policy, except with respect to any excess beyond the amount of the payment under such policy.
Agreement Not Exclusive. The indemnification provided by this Indemnification Agreement shall not be deemed exclusive of any other rights to which the INDEMNIFIED PARTY may be entitled under the law, the Articles of Incorporation or the Regulations of BANCORP or under any other agreement, vote of shareholders or disinterested directors, or otherwise, both as to action in her official capacity while holding such office, and shall continue after the INDEMNIFIED PARTY has ceased to be a director, trustee, officer, employee or agent of BANCORP.
Agreement Not Exclusive. The City retains the right to hire other professionals, contractors and service providers for this or other matters, in the City’s sole discretion.

Agreement Not Exclusive. (a) This Agreement shall not be exclusive and shall not be deemed to amend or alter the terms of other agreements between or among the Member Entities.
Agreement Not Exclusive. The parties acknowledge and agree that this is not an exclusive agreement. Without limiting the foregoing sentence, NCPS may render solicitation services of the kind contemplated herein for persons other than the Company.

(a) Except to the extent necessary to perform the Adviser’s obligations under this Agreement, nothing herein shall be deemed to limit or restrict the right of the Adviser, or any affiliate of the Adviser, or any employee of the Adviser, to engage in any other business or to devote time and attention to the management or other aspects of any other business, whether of a similar or dissimilar nature, or to render services of any kind to any other corporation, firm, individual or association.

The right to indemnification provided to Indemnitees under this Agreement shall be independent of, and neither subject to nor in derogation of, any other rights to indemnification or exculpation to which the GSS Representatives may be entitled, including, without limitation, any such rights that may be asserted under any other agreement, applicable corporate law, the Formation Document or any other contract or insurance.
Agreement Not Exclusive. The Advisor's present business is advising ----------------------- with respect to the purchase and sale of commodity interests. The services provided by the Advisor hereunder are not to be deemed exclusive. The Partnership and General Partner acknowledge that, subject to the terms of this Agreement, the Advisor may render advisory, consulting and management services to other clients for which it may charge fees similar or different from those charged to the Partnership. The Advisor shall be free to advise others and manage other accounts during the term of this Agreement and to use the same or different information, computer programs and trading strategies which it obtains, produces or utilizes in the performance of services for the Partnership.
