Common use of Aggregate Liability Cap Clause in Contracts

Aggregate Liability Cap. To the fullest extent permitted by law, ONS’s aggregate liability to the Customer for (a) the Platform will not exceed the amount the Customer has paid for the Platform in the 12 months preceding the event giving rise to the liability, or (b) a Course will not exceed the fees paid for the specific Course giving rise to the liability. This limitation will not apply to ONS’s obligations under Section 10.2.
