Agent for the Company. In acting under this Warrant Agreement and in connection with the Warrant Certificates, the Warrant Agent is acting solely as agent of the Company and does not assume any obligations or relationship of agency or trust for or with any of the holders of Warrant Certificates or beneficial owners of Warrants.
Agent for the Company. In acting under this Agreement and in connection with any Debt Warrant Certificate, the Debt Warrant Agent is acting solely as agent of the Company and does not assume any obligation or relationship of agency or trust for or with any Holder.
Agent for the Company. In acting under this Unit Agreement and in connection with the Unit Certificates, the Unit Agent is acting solely as agent of the Company and does not assume any obligations or relationship of agency or trust for or with any of the holders of Unit Certificates or beneficial owners of Units.
Agent for the Company. In acting under this Warrant Agreement and in connection with the Warrant Certificates, the Warrant Agent is acting solely as agent of the Company and does not assume any obligation or relationship of agency or trust for or with any of the holders of Warrant Certificates or beneficial owners of Warrants. Any action to be taken (other than an action involving a disbursement of funds, which will be taken only by Computershare), right to be exercised, notice to be given or signature or countersignature to be provided by the Warrant Agent under this Agreement or under a Warrant Certificate may be taken, exercised, given or provided by either of Computershare or Trust Company, as agent, and will be effective to bind both agents and for all other purposes under this Agreement.
Agent for the Company. In acting under this Agreement and in connection with any Common Stock Warrant Certificate, the Common Stock Warrant Agent is acting solely as agent of the Company and does not assume any obligation or relationship of agency or trust for or with any Holder.
Agent for the Company. In acting under this Warrant Agreement and in connection with the Warrant Certificates, except with respect to the Series A Preferred Stock, the Warrant Agent is acting as agent of the Company in a ministerial capacity and does not assume any obligation or relationship or agency or trust for or with any of the Holders of Warrant Certificates or beneficial owners of Warrants.
Agent for the Company. In acting in the capacity of Warrant Agent --- --------------------- under this Agreement, the Warrant Agent is acting solely as agent of the Company and does not assume any obligation or relationship of agency or trust with any of the owners or holders of the Warrants except as expressly set forth herein.
Agent for the Company. In acting under this Agreement and in connection with any Ordinary Share Warrant Certificate, the Ordinary Share Warrant Agent is acting solely as agent of the Company and does not assume any obligation or relationship of agency or trust for or with any Holder.
Agent for the Company. In acting under this Warrant Agreement and in connection with the Common Share Purchase Warrant Certificates or Pre-Funded Warrant Certificates, the Warrant Agent is acting solely as agent of the Company and does not assume any obligations or relationship of agency or trust for or with any of the Holders of the Common Share Purchase Warrant Certificates or Pre-Funded Warrant Certificates or beneficial owners of Common Share Purchase Warrants or Pre-Funded Warrants.
Agent for the Company. In acting under this Agreement and in connection with any Expedia Equity Warrant Certificate, the Equity Warrant Agent is acting solely as agent of the Company and does not assume any obligation or relationship of agency or trust for or with any Holder.
