Agency Response a. OGS will consider all information relevant to the Formal Dispute, and may, in its discretion, suspend, modify, or cancel the disputed procurement/Contract action prior to issuance of a Formal Dispute decision.

Agency Response. Within thirty (30) Days of receipt of the Notice of Claim, the Agency shall make available to the Comptroller a copy of all material submitted by the Agency to the Agency Head in connection with the dispute. The Agency may not present to the Comptroller any material not presented to the Agency Head, except at the request of the Comptroller.

Agency Response. If the Union President submits a proposal under this section, the Agency shall provide a written response within 15 days of receipt of the proposal, or submit a written request to the Union for a briefing. If the Agency requests a briefing, the Union shall provide the briefing in person or by telephone within 15 days of the Agency’s request. If the Union rejects the Agency determination, the Parties will strive to begin negotiating within 15 days or at another time agreed to by the Parties. The bargaining may be conducted in person or by telephone. If the Parties reach an agreement under this section, the agreement shall be set forth in a Memorandum of Agreement (MOA). Disputes over the interpretation or application of an MOA shall be resolved under the Grievances and Arbitration Article of this Agreement. If the Parties are unable to reach an agreement on a mid-term bargaining proposal submitted under this section, either Party may declare an impasse and present the impasse to the Federal Service Impasses Panel in accordance with its rules.
Agency Response. The Grievance Deciding Official, will respond in writing within fFifteen (15) days of either the meeting or receipt of the grievance if no meeting is requested. The response will contain the name of the Step 2 Grievance Deciding Official, if full relief is not granted.
