Common use of Agency Obligations Clause in Contracts

Agency Obligations. NO COST: The AGENCY shall provide such services in a professional manner in compliance with the State and Federal Weatherization Assistance Program specifications AT NO COST TO THE TENANT(S). An OWNER contribution may be required as identified in item 11 of Section B. herein. There shall be NO COST to the OWNER in the event the OWNER is eligible under the low income guidelines. RESPONSIBILITY: The AGENCY shall develop specifications based on results of an energy audit detailing work to be performed by the AGENCY. The AGENCY is responsible for overall construction management. AMENDMENTS OR CHANGES: Following the completion of an energy audit, the AGENCY shall inform the OWNER in writing of any amendments or changes to the weatherization measures to be performed/installed as identified in Attachment 1. If the OWNER rejects major weatherization measures, the project may not proceed. Major weatherization measures may include but are not limited to: air sealing; insulation; replacement of appliances such as a furnace or refrigerator.
