Affected Persons. 4. Who is affected by the class action? You are affected by the class action if you fall within the certified class and have not excluded yourself from the Class (see #6). The certified class is defined as all persons that own or have owned, lease or have leased, and all those who have or may pursue claims through or in the name or right of those who own or have owned, lease or have leased buildings in Canada that contain or have ever contained IKO Organic Shingles (see #3).
Affected Persons. The census will prima-facie identify tenants, leaseholders, sharecroppers, encroachers, squatters, and agricultural workers. During such census, those APs dependent on the existing infrastructure link for their livelihood, shall also be identified and listed along with their identified income. Besides this, the census will also identify APs who are from Scheduled Tribes (STs), and vulnerable APs such as the poor, female-headed, old, handicapped, infirm, orphaned, and destitute.

Affected Persons. If a consumer on a FMHO does not return from leave, the Nurse in Charge (NIC) must advise the ACAT as soon as practicable, via email to XXXXXxxxxxXxxxxx@xxx.xxx.xx The ACAT keeps a register of affected persons and will advise any affected persons registered for the consumer (Mental Health Act 2015, s. 134 (2)(c)). Back to Table of Contents Section 6Review and appeal of leave decisions Under the Mental Health Act 2015, a consumer has the right to seek ACAT review of some adverse leave decisions. The following decisions can be reviewed: Refusal to grant leave to a consumer on a FMHO (Mental Health Act 2015, s. 121) Refusal to grant leave in emergency or special circumstances to a consumer on a FMHO (Mental Health Act 2015, s. 122) Revocation of leave by the Chief Psychiatrist or Care Coordinator (Mental Health Act 2015, s. 123) Refusal to grant leave to a correctional patient (Mental Health Act 2015, s. 143), and Revocation of leave to a correctional patient (Mental Health Act 2015, s. 144). If a leave decision has been made by ACAT, the consumer may also appeal that decision within ACAT (see the ACAT Application for Appeal Form available from the Administration and Data Manager).

  • Parties This Agreement shall each inure to the benefit of and be binding upon the Underwriters and the Company and their respective successors. Nothing expressed or mentioned in this Agreement is intended or shall be construed to give any person, firm or corporation, other than the Underwriters and the Company and their respective successors and the controlling persons and officers and directors referred to in Sections 6 and 7 and their heirs and legal representatives, any legal or equitable right, remedy or claim under or in respect of this Agreement or any provision herein contained. This Agreement and all conditions and provisions hereof are intended to be for the sole and exclusive benefit of the Underwriters and the Company and their respective successors, and said controlling persons and officers and directors and their heirs and legal representatives, and for the benefit of no other person, firm or corporation. No purchaser of Securities from any Underwriter shall be deemed to be a successor by reason merely of such purchase.

  • Independent Parties This Agreement shall not be deemed to create any partnership, joint venture, or agency relationship between the Parties. Each Party shall act hereunder as an independent contractor.
