ADVERTISING PRACTICES. (A) Rogers and Shaw shall schedule all advertising content forming part of the National Area on a non-discriminatory manner and so as to maximize overall advertising revenue. Rogers and Shaw shall sell advertising to businesses in Canada for insertion in the Wave@Home Service and @Home shall sell advertising to businesses in the United States for insertion in the Wave@Home Service. Rogers and Shaw on the one hand and @Home on the other shall share leads (for which an appropriate commission shall be paid) but shall not sell any such advertising to businesses operating in the other's territory. All sales of advertising to be inserted in the Wave@Home Service shall be made in accordance with an advertising rate card for the Wave@Home Service; and

ADVERTISING PRACTICES. This MAP Policy applies to all advertisements, promotions, and marketing of the Products (collectively, “Advertisements”) in any and all media. The term “Advertisement(s)” includes, without limitation, flyers, posters, coupons, mailers, inserts, newspapers, magazines, catalogs, mail order catalogs, Internet or similar electronic media including websites, email newsletters, email solicitations, faxes, television, radio, and public signage. The MAP Policy is not applicable to any in-store advertising that is displayed only in the store and not distributed to any customer. In- store displays, point-of-sale signs, hangtags or bar codes or similar marks on products or product packaging which merely state the price are not considered “Advertisements” for purposes of this MAP Policy. In that regard, this MAP Policy does not apply to the actual sales price on any “check-out page” of any Customer’s website or related internet site (typically the page at which the end purchaser finally purchases the product). This MAP Policy does apply to any other page(s) on a Customer’s website. Advertisements do not have to feature a selling price for a Product. ADVERTISING PRACTICES. The Master Franchisee shall use reasonable efforts to ensure that the Stores' advertising policies and practices shall be generally consistent with the Franchisor's advertising practices taking into account the local rules and practices in the Territory. The Franchisor shall notify the Master Franchisee of any generally inconsistent advertising practices and permit the Master Franchisee a reasonable period of time to correct the inconsistency, failing which the Franchisor shall have the right to direct and administer the Advertising Fund.
