ADVANCE RENTAL. Upon execution of this Lease, Lessee shall pay to Lessor an advance payment in an amount equal to the Rent Factor multiplied by the Master Lease Line (plus applicable taxes) (the "Advance Rental"). A pro-rata portion of the Advance Rental shall be deemed to prepay as of the date of this Lease the last Rental Payment for each Schedule. If the Master Lease Line has not been fully expended by the Funding Expiration Date, Lessor shall retain the unutilized portion of the Advance Rental as compensation for expenses.
ADVANCE RENTAL. As of the date hereof, Tenant shall pay to Landlord the sum equal to One Hundred Fourteen Thousand Three Hundred Twenty and 80/100 Dollars ($114,320.80), which sum represents the Base Annual Rent for the first (1st) and last months of the Term together with all Common Area Expenses and all other Additional Charges for the same period (“Advance Rental”), which Advance Rental shall be applied to the Base Annual Rent, Common Area Expenses and all other Additional Charges for the month of the Term in which the Rent Commencement Date occurs with any remaining Advance Rental to be applied to said expenses for the last month of the Term at the time such Advance Rental would have become due and owing under the Lease. Tenant shall, upon Landlord’s notice thereof, pay to Landlord any remaining sums due for said first and last months of the Term in the event that the amount of Advance Rental for such months is insufficient to meet all of Tenant’s obligations hereunder for said months. Tenant hereby waives the benefit of any provision of law requiring such Advance Rental to be held in escrow or in trust, and said Advance Rental shall be deemed to be the property of Landlord and may be commingled with Landlord’s other funds. Tenant further waives the benefit of any provision of law requiring that interest be paid on such Advance Rental. Notwithstanding the foregoing, in the event that Tenant is in default of any of the terms and provisions of this Lease beyond any applicable grace or cure period, then Landlord may apply the Advance Rental against any sums which may become due and owing as a result of said default.

ADVANCE RENTAL. LANDLORD acknowledges receipt from TENANT an amount equal to the annual base rent and additional rent for the first full calendar month of the term hereof as advance rental. If TENANT is in compliance with all of the terms, covenants and conditions of this Lease, the aforesaid advance rental shall be credited against the first rental payment due hereunder; otherwise, LANDLORD shall have the right to use, apply or retain the whole or any part of the advance rental to the extent required for the payment of any annual base rent and additional rent or any other sums due LANDLORD hereunder; including any sums which LANDLORD may expend or may be required to expend by reason of TENANT’S failure to observe or comply with any of the terms, covenants and conditions of this Lease. In the event that LANDLORD should sell or otherwise transfer or assign its interest in the Shopping Center or the Demised Premises prior to crediting the advance rental, LANDLORD may deliver the advance rental to the purchaser or other assignee or transferee of LANDLORD’S interest, in which event LANDLORD shall be discharged from any further liability with respect to such advance rental. TENANT agrees that said advance rental shall be forfeited if TENANT does not open for business as required herein. No interest shall be paid or payable on the advance rental.
ADVANCE RENTAL. Lessee shall pay to Lessor upon execution hereof an advance payment equal to one month of estimated Base Rent for all Buildings in the sum of Two Million One Hundred Forty-Five Thousand Dollars and no Cents ($2,145,000.00), subject to being adjusted upon final measurement of each of the Buildings on or before the Delivery Date for such Building, said payment to be applied to the first monthly installments of Base Rent (and Base Rent for the following months, to the extent this advance payment exceeds the first monthly installments of Base Rent as a result of said final measurement of the Buildings). If the Commencement Date is other than the first day of a calendar month, the first installment of Base Rent shall be paid on the first day of the calendar month immediately succeeding the Commencement Date and shall include pro rata payment for the calendar month in which the Commencement Date occurs, less credit for the advance payment.
ADVANCE RENTAL. The Landlord hereby acknowledges receipt from the Tenant of the sum of One Hundred Twenty Five Thousand Three Hundred Seventy One Dollars and Eighty Three Cents ($125,371.83) inclusive of G.S.T. to be held without interest and applied against the first and last months’ installments of Annual Rent and Additional Rent.
ADVANCE RENTAL. Until this Agreement is sooner terminated, Lessee shall pay to Lessor Advance Rentals according to the following schedule: Seven Thousand Five Hundred ($7,500.00) dollars upon the execution of this Agreement for the first year commencing the date of this Agreement and ending on the first anniversary thereof. Commencing with the first anniversary of this Agreement and ending on the fifth anniversary of this Agreement, the then Advance Rental shall increase Twenty-Five Hundred ($2,500) dollars until the annual Advance Rental is Twenty Thousand ($20,000.00) dollars. Commencing with the fifth anniversary of this Agreement through the ninth anniversary of this Agreement, the annual Advance Rental shall be Twenty Thousand ($20,000.00) dollars. The Advance Rental after the initial amount shall be due on the anniversary date of this Agreement commencing with the first anniversary and ending with the ninth anniversary thereof. Payments of the Advance Rental received within fifteen calendar days of the anniversary due date will be deemed timely made. The Advance Rental payments payable to Lessor pursuant to this paragraph shall be credited to and recoverable from Production Rental payments payable by Lessee to Lessor, as provided below. Said right of recovery shall apply to the first such Production Rental payment accruing and shall continue thereafter until Lessee has recovered the full amount of previously paid Advance Rental payments.
ADVANCE RENTAL. Notwithstanding any provision in the Lease to the contrary, Seller and Buyer acknowledge that no advance rental or other form of security deposit has been paid by Lessee.
