Common use of Administrative Agent and Affiliates Clause in Contracts

Administrative Agent and Affiliates. With respect to any Loan or interests therein owned by it, the Administrative Agent shall have the same rights and powers under this Agreement as any Lender and may exercise the same as though it were not the Administrative Agent. The Administrative Agent and any of its Affiliates may generally engage in any kind of business with any Transaction Party or the Company, any of their respective Affiliates and any Person who may do business with or own securities of any Transaction Party or the Company or any of their respective Affiliates, all as if the Administrative Agent were not the Administrative Agent and without any duty to account therefor to any Lenders.

Administrative Agent and Affiliates. With respect to the Commitments and the Loans, the Administrative Agent as a Lender and any Loan or interests therein owned by it, Lender which is an Affiliate of the Administrative Agent shall have the same rights and powers under this Agreement hereunder as any other Lender and may exercise the same as though it were not the Administrative Agent.
