Common use of Adjacent Excavation-Shoring Clause in Contracts

Adjacent Excavation-Shoring. If an excavation shall be made, or shall be authorized to be made, upon land adjacent to the Real Property, Tenant shall, upon notice, afford to the Person causing or authorized to cause such excavation a license to enter upon the Premises for the purpose of doing such work as such person shall deem necessary to preserve the Buildings or any other part of the Center from injury or damage and to support the Buildings or such part of the Center by proper foundations. In connection with such license, Tenant shall have no right to claim any damages or indemnity against Landlord, or diminution or abatement of Rent, provided that Tenant shall continue to have access to the Premises.

If an excavation shall be mademade upon land adjacent to the Premises, or shall be authorized to be made, upon land adjacent to the Real Property, Tenant shall, upon reasonable advance notice, afford to the Person Landlord or any Governmental Authority causing or authorized to cause such excavation a excavation, license to enter upon the Premises for the purpose of doing such work as Landlord or such person Governmental Authority shall deem deem, in its or their sole discretion, necessary to preserve the Buildings or any other part wall of the Center Building from injury or damage and to support the Buildings or such part of the Center same by proper foundations. In connection with such license, Tenant shall have no right to foundations without any claim any for damages or indemnity against Landlord, or diminution or abatement of Rent, Rental provided that Tenant shall continue to have access to the PremisesPremises and the Building.

In connection with such license, Tenant shall have no right to claim any damages or indemnity against Landlord, or seek diminution of Rent or abatement of Rentother concession, provided that Tenant shall continue to have access to the Premisesdemised premises.
